Special Prosecution Still Without Decision in Astrit Deharit Case

It has been almost a month since State Prosecutor Alexander Lumezi has decided that the Astrit Dehar case will be passed by the Constitutional Prosecutor in Prizren to the jurisdiction of the Special Prosecutor of the Republic of Kosovo. But since then, the Special Prosecutor has not made a decision as to how far [the] process has gone...

But since then, the Special Prosecutor has yet to issue an agreement on how far the investigation process has gone.

Astrit Dehar's family lawyer, Tome Gashi, says of Online Economy, that this prosecutor does not have the luxury of achieving this process and that next week, according to his competencies, he will take certain legal actions.

“Although it has now become 1 month, the Special Prosecutor has yet to issue an agreement on the development of investigations with which they would actually begin investigations into the identification of Astrit Dehar's assassins, to identify the assassins and specifically to those who have been hiding the murder for more than three years. So far we've submitted three requests and all the requests that have been submitted for all written forms have also been announced to Chief Prosecutor Alexander Lumez and we actually have nothing more to expect. As of next week, we will take other specific legal actions so that the prosecution can be put into office of the law in its own function and not keep the subject it received from the prosecution in Prizren. There is no reason to hold such a course without making a decision to conduct investigations in terms of identifying Astrit Deharit” killers, Gashi stressed.

He says that the prosecution now has nothing to investigate with the previous theory, since three years have sufficed to know the truth that was known by the first day that Astrit Dehar was killed.

The “seems to be a neglect, we can't yet say intentional, but it seems that they have needed a specific time just to come to legal ways to make a decision to develop investigations and engage Kosovo Police relevant units, Kosovo's best investigators, to identify Astrit Dehar's killers. I think it's legal duty for prosecutors. If they do not act in such a way, then automatically under the law, Astrit Dehar's family may require through me that they completely leave this serious criminal case”, Gashi added.

Gashi further said that even Chief Prosecutor Alexander Lumezi would have to seek accounts from the prosecutor of the case, who they still do not know who he is assigned to.

I believe that also Alexnder Lumezi would be accountable to the prosecutor of the case, for which we still don't know who he was separated, for now we're actually legally cooperating with the papers of the Kosovo Special Prosecutor's Chief Prosecutor and besides a letter they've been responding to in the systeming of subjects and inviting me as a lawyer of the Dehari family but the parents of Astri Dehar to coordinate the work until now has not happened, he said,

Furthermore, Gashi says the prosecutor of the case, but even the state prosecutor knows that in the case of making the decision to conduct investigations in terms of identifying Astrit Dehar's killers, those hiding the case should be arrested

“I believe that the prosecutor of the case, but even the state prosecutor, knows that with the case of the investigation decision to identify Astrit Dehar's killers, a portion means an indefinite number that we don't know how many top state officials might be. So those who have concealed the case would have to be arrested and I believe that there are other legal calculations I'm not saying policy that have pushed the Special Prosecutor and State Attorney to this day not to take certain actions or perhaps have undertaken for which we haven't been informed so far, it's over, Gashi.

The Constitutional Prosecutor in Prizren, on 24 October, has published conclusions of the expertise of the Swiss Institute of Legal Medicine in Lozanne, in the case of Astrit Deharit.

Astrit died on November 5, 2016, while he was being held at Prizren's Prevention Centre as suspected of attacking the Parliament building in August 2016.
