Long-standing negotiations between the two political parties, which came first in the elections held on 6 October, LVV and LDK, are not producing results in the formation of the ruling coalition.

Although the working groups of both parties in a round of meetings had harmonised as they say the 100 per cent governing programme, the leaders of these political subjects are now failing to agree on the division of office.

The day was set for Monday when the agreement between LVV and LDK would also be finalised, but that did not happen.

The meeting yesterday between Albin Kurt and Isa Mustaf resulted without concrete agreement.

It seems to have turned out to be the post of president, who was placed at the recently discussed table and the division of ministerial posts.

But what if LVV fails to form government?

Renowned Kosovo analyst Shkelzen Maliqi has clarified for Periscope that if the winning election party -- in this case LVV -- fails to secure votes for forming the government, then the president should have mandated the second winning party to form Government.

Even though Maliqi believes it will not come to this point, he has said that the country's President Hashim Thaci after the confirmation of the election result had to invite the winning party.

The “depends on the president, should start conversations with other parties. First the president must invite the winning party to mandate the new government, and if he cannot make Albin Kurti 61 votes, he should spend some time and then give the other his mandate. If even the second party fails to form the government, then the country goes to the elections”, Maliqi has said of Periscope.

While analyst Arton Demhaya has told Periskopi that if the first party after a period set after the president's mandate fails to secure the necessary parliamentary majority for the establishment of the Government, then it is in the president's discretion if he will give the mandate for the second time to the first party, or the second party that has emerged from the election results.

“On the basis of the Constitutional Constitution, the president is obliged to give the mandate to the first party, and if after a certain deadline he fails to secure the necessary parliamentary majority for the government's creation, then he is in the president's discretion if he will give the first party the opportunity to mandate another candidate, or he will grant the possibility of the second party”, Demhasaj said.

He stressed that if in both cases the Government's creation fails, then again the word will be made by the president who makes the announcement of new elections.

The commitment implies, that the head of state in consultation with all political parties that have secured seats in the assembly from the October 6th elections, ensures who has the necessary majority of 61 MPs, which is guaranteed through the signatures of the CEC's certified deputies and sworn oaths at the constitutional session.
