Actual to seven officials in Malisheva for misuse of official position

The defendant J.K., in 16,11.18, in Malisheva, the quality of the commission chairman and two defendants, J. The S., and B.K., in the quality of the commission's members for accepting works on the channeling network project in the village of Balinca, in the technical accession report, have posted false data proving that contracts have been met, with the economic operator N.T.“Flag” in Malisheva, and meets the conditions for use, where the total value has been 9.870 euros, even though the same ones have not done the jobs according to the required contract criteria.

The defendant I.V., in the quality of the director of Urbanism and the defendant V.M., in the quality of the channeling project manager in the village of Ballinca, in the official document, have recorded false data proving that after leaving for the field, work has been done on the basis of the contract project, recommending that payment be made for realisation of these works, even though the work had not been performed under the required conditions in the contract.

With such actions there is a well - founded suspicion that defendants J.C., J. S., B.K., I.V., and V.M. have fulfilled the elements of the criminal act “Falsification of the official document” by Article 434 paragraph 1 related to Article 31 of KPRK.

The defendant R.M., during the month of October 2018 in Malisheva, in the quality of the person responsible for the N.T. economic operator. “Falmur”, in Malisheva, has deliberately violated the business law by acting in opposition to the regular standards of business, where after winning the contract to carry out sewer work in the village of Balinca, it has not met the conditions required under contract, thus causing contractors, the Malisheva Commission, worth 9,870,18 euros.

With these actions, there is good-based suspicion that the defendant has fulfilled elements of the criminal act “The irresponsible economic player”, from Article 285 paragraph 1 of the KPRC.

The defendant Q.K., in 12,02.2018, in the quality of the official person, at the Urbanism Directorate in the Malisheva municipality, has misused his position in order to bring against-lawed wealth benefits to himself and others, in terms of horizontal drilling arrangements for the passage of a 55m-long sewer, worth 3500 euros, even though the same horizontal drilling existed in the same place, causing the authority of the Malishev Commission's contracting material damage to 3500 euros.

With these actions, there is good-based suspicion that the defendant has fulfilled elements of the criminal act “The use of official position or authority”, from Article 422 paragraph 1 point 2.1 of KPRK.

The prosecutor has proposed to the Constitutional Court in Gjakova that defendants R.M., J.K., J. U.S., B.C., I.V., V.M., and K.K., will be punished according to the law for criminal acts that were imposed on them.
