This table aims to discuss the Supreme Court's constitutional obligations to ensure that its decisions proving the state of lawlessness are effectively addressed by lower courts.
Moreover, the discussion will focus on the practices of countries in the region and the way to address such cases.
A policy analysis titled “Supreme Court decisions will be published during this discussion: Their influence on the Kosovo judicial system”.
This study analyses some of the cases where the Supreme Court of Kosovo is deciding regarding the requirements for protection of the legality put forward by the State Prosecutor, issues convictions in which criminal law is found.
As a result, the same does not undermine the decisions of the strict form of lower courts, those of the Court of Appeals respectively, but are limited to the conclusion of violations of criminal law.
