Judgment in the People's Office case postponed

In the absence of a court member, Judge Vesel Ismajli on Wednesday, has failed to hold trial for acts against constitutional order and other criminal acts, in the case known as “The People's Office”.
In this case, Sadri Ramabaja, Murat Jashari, Ragip Salova, Avni Llumnica, Sabit Berisha, Bexhet Luzha, Halim Halimi, Bajrush Konjusa, Lixhije Luzha and Recep Toplana are charged, reports “Betim for Justice”.
According to Judge Naim Krasniqi-Jashnica, Judge Ismajli has an official trip to Germany, which for this trip, she said was unaware until last Friday, until she added that she had earlier canceled the orders for conduct by detention for the accused Ramabaja, Salova and Yashari.
Krasniqi -Jashnica has declared that the next hearings in this case will be held on December 12th and December 13, 2019, at 09:30.
Regarding this postponement of the session, lawyer Ramiz Krasniqi, defender of accused Ramabaja, who has declared that the lack of a court member is unacceptable when the same one has been aware of the 30 October session.
According to Krasniqi, for this case the accused are in custody for two years and this should be considered.
Presented in this review was Special Prosecutor for Kosovo (PSRK) Syla Hoxha and the accused who were not in custody.
The protection of some of the accused who had not yet been declared on charges against them was expected.
While, in previous hearings, accused Llumnica, Ramabaya, Halimi and Luzha were heard.
The Special Prosecutor of the Republic of Kosovo (PSRK), on February 27th 2018, has filed an indictment against Avni Llumnica, Ragip Salova, Sadri Ramabaja, Sabit Berisha, Behxhet Luza, Halim Halimi, Bajrush Konjusha, Freedom Luzha and Rexhep Toplana for various criminal acts.
According to the indictment, defendant Avni Llumnica deliberately intended for accused Murat Jashar to kill the injured Azem Vlasi for revenge, had given Jashar help in carrying out the criminal act.
Llumnica reportedly had taken him from Switzerland to Kosovo on March 6, 2017, accused Murat Jashari, to his home, while one day later he sent him to motel “Fontana” in Veternik, where he even paid for his sleep at this motel.
While, according to the prosecution's claims, when defendant Murat Jashar had committed criminal acts against Azem Vlases, he and the accused Llumnica had met in the city and had wanted to leave for Switzerland at 12 p.m. were arrested by Kosovo police.
With this, Llumnica is accused of committing criminal work “in aid” by Article 396 KPRK's.
Llumnica according to this indictment as it was at the Lipjan detention centre on May 16, 2017, says that using the cano and force has violated the injured N.Z. by putting it in the detention room and forcing the same one to have oral sex. According to Llumnica, even before the case occurred several days earlier, he had sexually molested the man who was injured in speech.
Llumnica charged with criminal work “violence” by Article 230 KPRK's.
The defendants, Murat Jashari, Avni Llumnica, Ragip Salova, Sadri Ramabaja, Rexhep Topalla, Bajrush Konjusa, Sabit Berisha, Haliim Halimi, Bexha and Lije Luzha, are claimed that on May 15th 2017, as reportedly members of the criminal organisation “Syr of the people, with the so-called ouseve Rrustema Rrustema somewhere in a European state, had started illegally at the goal of destabilizing or destroying the fundamental political structures of Kosovo's constitutional structure, or constitutional Republic.
According to the indictment, the same reportedly had planned attacks and murders on top state personalities considered former officers of the 1980s-1991 as the country's traitors. These attacks, according to the indictment, were planned to carry out to Kosovo President Hashim Thaci, Parliament Speaker Kadri Veselin, former Prime Minister Isa Mustafa, former Prime Minister Hajredin Kuci, Xhavit Haliti, Fatmir Limaj, continuing with commanders of the KLA war, ATK director, religious clergy, etc.
According to the indictment, this group with the intention of killing those whom they considered to be traitors had founded the “Freedom of the Homeland” and as the organisation “The People's Office” had a structure divided under the hierarchy, had coded names and various tasks are said among the other in the indictment.
While, defendant Murat Jashar is said to have attempted to kill Azem Vlasi as a former official who, according to them, was named first on the country's traitor list.
With this, they are accused of committing criminal work “the preparation of terrorist acts or criminal acts against the constitutional order and security of the Republic of Kosovo” by Article 144 I KPRK's.
Defendant Bajrush Konjusha is also charged with the criminal work “ownership, unauthorized control or possession of weapons “since a gas pistol and a 250-sharp airgun had been confiscated in his house.
While, Murat Jashari of the PSRK, is being charged with criminal acts “capitalisation” and criminal work “ownership, control or unauthorized possession of weapons”.
The prosecution claims that Jashar, being able of mental inability to understand and control his actions due to the schizoafecent-humanist disorder, with permanent character, on March 13th 2017, has gone to the residence of the injured Azem Vlasi in Pristina, to deprive him of life as former senior leader of LKJ and former Kosovo leader, considering the same as a traitor because of his stand on 191 demonstrations and the national issue.
On the other hand, the indictment says that Jashari was initially interested in committing Vlads to civil affairs as a lawyer, while he told him that he did not deal with civil affairs, suggesting that he be directed to another lawyer and, after second contact with him, the accused has pulled out the key to the type “Crvena Zastava <stava1>, with the deaf facing the injury.
Furthermore, the prosecution claims that Vlase has seized the gun from Jashar and is seated, which has influenced the bullet to hit Vlad on the left of his chest, causing serious bodily injury. After that, Jashar had once again attempted to shoot the victim, but Jashar had been blocked and then fled from the scene, to meet with defendant Avni Llumnica, to be arrested by police at motel “Fontana”, Veternik.
According to the indictment, after police had made a search at motel “The Fontana”, at Jashari, was found and confiscated a type “Crvena Zastava”, 70-65 mm calibration model, deafer, and a 7-shooter, which he used without permission.
