Sentenced to six months of effective imprisonment after being seized by 0.70 grams of marijuana-like narcotics, Mergim Luzha, through his lawyer, Labinota Qosa-Ilazi is seeking to ease the sentence by the Court of Appeals.

The Foundation Court in Ferizaj, on September 21st of last year, had convicted Luzha after the same earlier admitted guilt for criminal work “trading, possession, distribution and unauthorized selling of narcotics, psychotropic and analogue”.

In addition to the six-month sentence of effective prison terms, the court of accused Luza had also pronounced the cash penalty at the height of 200 euros in fines, reports “Justice Vought”.

However, unhappy with the height of the pronounced sentence, Lucza's defender, lawyer Labinota Qosa-Ilazi has filed complaints at the second-degree court because of the sentence ruling.

This defence complaint, as well as the Appeals Prosecutor's Statement regarding it, were reviewed Thursday by a College of the Court of Appeals.

According to the defence complaint, which was referred to by the reporting judge for the case, Driton Muharremi, the sentence pronounced on the first degree is high considering that the accused has consistently been co-operative with law enforcement, has pleaded guilty to the work done, stems from an educated family, and that this is the first time the same conflict with the law.

Also, according to the complaint, the conviction pronounced against Luz is high since, according to the practice of courts in Kosovo, conditional sentences are usually pronounced in similar cases.

Based on all these circumstances, lawyer Qosa-Ilazi has proposed to Apel that court remarks or parole be pronounced against her defenders.

“Based on all these circumstances that were mentioned, given that the same has not been convicted before and that the substance has been for personal use, we beg for the college to approve”, lawyer Qosa said in her address.

On the other hand, the Appeals Prosecutor through a parachute to the second-instance court has proposed to the latter to refuse the defense complaint and to prove the first degree of judgment.

Otherwise, Mergim Luza was charged by the Constitutional Prosecutor at Ferizaj, that on November 30th 2018, at 1500, in high school “Feria Stone and Brothers Chaka” in Kacanik, during the Kosovo Police Operational Plan “Stop the drugs at the school”, the police station patrol at Kacanik has stopped Mergim Luzha and has found a half - cigarette with marijuana-like narcotics, weighing 0.32 grams and a bag of narcothea substance weighing 0.38 grams.
