Special Prosecutor Silas Hoxha confirmed that the prosecution has accepted the invitation for the initial session.
The Special Prosecutor of the Republic of Kosovo has filed charges against the 12 defendants for the subject known in the opinion as “Vecerians” in terms of criminal activity “the misuse of official position or authority”.
Also, in the indictment it has been proposed that the Court issue the measure to prevent the payment of legally acquired pensions as KLA war crimes veterans until the end of the criminal procedure.
According to the Special Prosecutor's claims from the evidence provided so far has proved that illegal fees for KLA war veterans have been damaged in many of the 68m 153m and 533 euros and 14 cents.
The court had turned the indictment back on October 9th 2018, demanding from the Kosovo Special Prosecutor's Office improvement within 30 days.
The Special Prosecutor after failing to hand him over within the deadline set at the hearing, had asked Judge Nushe Kuka-Meccaj for an additional 30 days.
The indictment had returned in order to clarify how the accused committed a criminal act: Agim Ceku, Nuredin Lushtaku, Sadik Halijaga, Shumbin Demalijaj, Qele Gashi, Shukri Buja, Ahmet Daku, Rrustem Berisha, Faik Fazliu, Smajl Elezaj, Fadil Shudreaj and Xhavit Jashar.
The court has also demanded that the number of people allegedly profit illegally be clarified, so it asks the Special Prosecutor to clarify the number of beneficiaries whether there are 20.238 or 15,115 persons who receive pensions from the Kosovo budget.
The change in court has also called for the prosecution's request for the suspension of pension payment for 20 thousand and 238 veteran fighters until the end of the criminal procedure, and according to the Nushe Kuka-Mekaj case, it would be better for the issue to be addressed in any other procedure the cause of procrastination to the limit of this trial.
Because it is about a huge number of people, exceeding 20.999, it is clear that deciding on a wealth of judicial requirement along with criminal procedure would devalve the criminal case as a second-hand issue and put the procedure back to unlimited limits, so I consider that such a matter to be addressed in any other procedure with the prosecutor's initiative, says the Court's decision, KALLXO.com.
The reason for such procrastination, according to the Court, is that if the security measure is allowed, the decision must be sent to the 20,238 veterans, who are affected by this measure and who have a right to a complaint, for which the college of the three judges should decide, and given the large number of complaints to be filed, the judicial process would drag on to unlimited limits.
