Meanwhile, the appointment of new members had delayed President Hashim Thaci, who after several months addressed the Constitutional Court to clarify whether parliamentary groups that were formed after the elections should have representatives in the CEC. However, the Constitution had rejected Thaci's request, saying the issue is not in its competence and that there is already a Constitutional Court clarification of what is considered the parliamentary group.

The two opposition LDK and LVV parties, which consider it a violation of the Kosovo Law for Elections and Constitution, have sent out two names for representatives to the CEC, not one, as Thaci has asked them. Despite that, Thaci has not yet decreed the names of new CEC members, while at least two parties have not yet sent Thaci the names of their representatives to Thaci.
