Macedonia's Constitution decided: Referendum in accordance with Constitution

Supporters of the initiative were only Judge Jovan Josifovski and Judge Elena Gosheva.

I appreciate from the analysis that there are particular legal shortcomings, which is according to the Constitution. Judges Sali Murati, Osman Kadriu, Naser Aydari, Vdalmir Stojanovski, Darko Kostadinovski and Vangelin Markokova, as well as Court Chairman Nikola Ivanovski all opposed the initiative.

Judge Sali Murat has been comparing the 91st referendum, when, as he said, there have been more questions in one and for it should not be challenged constitutionally.

According to Judge Osman Kadriu, no provision of the Constitution has been violated with the referendum ruling.

He said this decision has emerged from the legislature's house and should not contest its legitimacy, writes TV21.

“The decision cannot be said to be illegal because it has been approved by the majority of votes in lawmakers.”, the constitutional judge Osman Kadriu said.

In the Constitutional Court, three initiatives have been achieved to assess the constitutionality of the referendum declaration decision.

Predators of initiatives after the decision indicated that the court has worked under political jurisdiction and that legal and constitutional facts have not been taken into account.

Todor Petrov from the World Macedonian Congress said it was clear that the oppression done to judges was done.

The hearing judges were contradictory. They refused to debate the Agreement with Greece, but concluded that the referendum issue is not voted for the EU and NATO, but on the Agreement with Greece. The court, unfortunately, considered that the EU is not even an alliance for which the referendum should be announced.”, Macedonian World Congress Chairman Todor Petrov said.

The forger of the other initiative, Dimitar Asasiev of Levica, charged that someone has called the judges and wanted to influence their decision on initiatives.

This is a shameful day for rule of law in the Republic of Macedonia. Today, the rule of law kneels through a political decision, not a legal decision by judges. Our job as an opinion is to see who called the judges and tried to influence the outcome of this initiative”, Dimitar Apasev said, from the left party.

Despite these reactions, government spokesman Mile Bosnjakovski has stressed that the government in any situation will not comment on decisions brought by the Constitutional Court. /21Media
