The Court of Appeals has finally ruled today that the Randa Crime Department is responsible for the trial of Adem Grabovci, current Minister of Innovation and Protection, Besim Beqaj, MP Zenun Pajaziti, official Arbenita Pajaziti, of others mentioned at the “Proto”>.
Thus the Constitutional Court decision in Pristina and Judge Shasivvar Hoti has been abolished, which is imposed for non-competition of the Randa Crime Department to try this subject, following the request of Adem Grabovci's defence attorney, Florent Latifaj.
The Foundation's decision had been rejected by special prosecutor Drita Hajdari.
The appeal has found that, according to the “that the subject is not punishable until 10 years in prison, and it is not listed in the group of works that should judge the Randa Crimes, according to Article 1.20 paragraph 15 of the Law on Courts, the Randa Crime Department is tasked to judge any crime that is not listed in this article, which falls into the exclusive authority or subordinates of the Special Prosecutor's Office of Kosovo, as defined in the law regulating PSC-<>
Betim Musliu of the Kosovo Institute for Justice, says that regardless of the subject will be tried in the Randa Crime Department, expectations are small, due to political influences, because according to him, this indictment is selective, as it has left out the main protagonists.
The retired prosecutor, Elez Blakaj, had directly charged Chief Prosecutor Lumezi with interference during the establishment of the case's indictment “Proto”.
In the public letter, Blakaj said that at a meeting he had invited with prosecutors Reshat Milaku, Drita Hajdari and Lulzim Sylejmani, Lumezi, he had called for an account of why the indictment had been filed in the Proto case.
He had even threatened to send him to the disciplinary commission if he did not examine the indictment of the case “Proto”, and all of this, according to Blakins, Lumez had done it after he met with the Minister of Innovation, Besim Beqaj.
Lumez himself has been accepted by Beqaj, saying that it was a coincidence at a party.
