State chief prosecutor Aleksandar Lumezi has said prosecutor Elez Blakaj has not resigned because of threats either within or outside the prosecution. According to state prosecutor's first information, the act of resignation was not due to threats, but because of his commitment to any other task. Lumezi says prosecutor Blakaj had prepared a draft indictment for the huge veterans' lists, which only Blakaj's chief, Reshat Milaku, has seen.
Kosovo's justice was shocked when, during Wednesday, Prosecutor Elezj Blakaj, who was dealing with one of the most volume files since the war resigned.
The special prosecutor who was handling the KLA's swollen lists, which were suspected of having fingered the commanders, politicians, and representatives of war organisations left the post following threats.
The following day, for T7 about Blakaj's resignation, chief state prosecutor has spoken. The claims that someone might have threatened the former Prosecutor to handle this file are rejecting Alexander Lumez.
According to the announcement Blakaj was given, he was not withdrawn because of the row because he was a staunch and uncorrupted and courageous prosecutor. According to the information we have, it wasn't the act of resignation because of the threat, but because of his commitment to any other task”, Lumez made it known.
Lumez also says prosecutor Blakaj had not delivered charges for the huge veterans' lists, but only a draft indictment.
“Elez Blakaj has actually investigated this case, even though he has already prepared a draft indictment he has reviewed along with his chief prosecutor, Mr. Milak. But the Criminal Procedure Code, respectively, stipulates that every three months, the prosecution of the case should consult its chief prosecutor and establish whether the investigation should be closed or the indictment act should be filed. There has been an indictment draft which has been handed over to the chief prosecutor, but has not been handed over to the court, that the prosecutor has the obligation that the prosecution act in sufficient copies be sent to the competent court and then considered an indictment in court. In this case we don't have an indictment, and it's considered that investigations are ongoing and I don't know what was the conversation between the prosecutor and chief prosecutor”, Lumez said away.
Chief State Prosecutor denies that Blakaj had been pressured from within the prosecution to resign.
I don't have any information that someone from the prosecution told him to quit the job I didn't have any information, but during the conversation I had with Blake made a warning that he might even leave the prosecutorial system and see him get another job in local institutions or some foreign state. I haven't seen the indictment and I've asked the special prosecution to see it and they told me that the person who is replacing Chief Prosecutor Milaku told me that he doesn't have this indictment and I haven't seen him until now,
Lumez has also stressed that Blakaj was not threatened, but was concerned and had sought escorts of his children to school by police. The chief prosecutor does not indicate whether to arrest the already resigned prosecutor's threats.
The prosecutor has, of course, never said they were threats, but has been concerned about a rowing that has been linked to the case of Imam Shefqet Krasniqi until he was in the main judicial examination. And based on this information I've asked the Police Director to discuss it and secure the defense. He didn't ask for protection, but he wanted to protect the kids from going back to school and that was done by the police. We will appreciate that if there have been threats first, it should be estimated that those allegations that were addressed to the prosecutor Blakaj present the criminal work of the row because to exist the work has to be serious and that the feeling of uncertainty towards the other person the attack will follow. We have been following even previous threats, but whenever there was any threat to any prosecutor, he presented him to the Kosovo Prosecutorial Council. In this case, we have no case in the KKP for defending or threatening Blakaj”, Lumez has said.
And who's going to replace Blakay to investigate the enormous veterans' lists, he says it's not yet decided.
The “Ende has not been decided on who the prosecutor will be because we have to do a verbal process on accepting and handing over the subjects that Mr. Blakaj has behind him and see in which phase of the procedure those subjects are found and then the chief Special Prosecutor's Prosecutor's Prosecutor will make the distribution of these”, the chief prosecutor suggested.
By contrast, the media today have published the letter of resignation, where prosecutor Elez Blakaj has mentioned the fact that Special Prosecutor Chief Prosecutor Reshat Milaku had handed over the indictment for KLA veterans' lists, but at the basic Court in Pristina have said no charges have been submitted concerning KLA veterans' lists.
