In response, from College I SPE has deemed this action illegal to AKA.
“SPE through this public response once again denouncing the illegal acts committed by the Kosovo Agency for Accreditation, also calls on the Government of Kosovo and all other institutional mechanisms, including the State Prosecutor and the Ombudsman, as well as the entire European and international factor present in Kosovo to use all their legal means and opportunities in order to prevent the continued persecution being done to this institution, academic staff, students and students and parents of students<1>, the response reported.
The college insists it has met all criteria required for regular academic staff for each study programme.
On the other hand, Prime Minister Ramush Haradinaj has called for measures towards Education Minister Shyqi Bytyqi.
Read the following reaction and their requests:
The broad public opinion in Kosovo and all the aforementioned mechanisms should be informed of the facts as follows:
- In the sign itself published by AKA itself, on Thursday, dated 26.7,2018, it is clear that College I SPE meets all criteria required by the AKA itself for regular academic staff for each study program, while to the surprise of all with today's College decision I The SPP was removed from accredited and re-accredited programmes already from four (4), respectively five times in a row as a result of the assessment by international experts;
- The lifting of accreditation is in stark conflict with the legal acts that regulate this issue, where it is very clear that Administrative Guide No. 09-2017, Article 21 predicts that the removal/revote of accreditation could occur only after conducting the monitoring report of international foreign ratings, which in this case must prove that the actual situation in the institution has been damaged in terms of quality security. Explaining the general public opinion that no inspection and monitoring was conducted at College I SPE to be put to this decision;
- The Legal Department of the Ministry of Education, Science and Technology of Kosovo in the Legal Paper with No. 2/2-3600, dated 01.11.2017, states that the suspension of college I programs The SPE has been made in full opposition to the legal acts in power that regulate this area and thus the AKA has completely ignored this document by not considering it at all and continuing with the practice of making decisions groundless in law;
- Minister of Education, Mr. Bytyqi's opponent dismissed U. The AKA Director's D just minutes before the launch of the Accreditation Agency's collection, and the Agency's Board has subsequently made decisions without the existence of the AKA Director as the legally competent for preparing the AKA Board's meetings, where it is known among other things that the director of the AKA is also an executive member of the Accreditation Agency Board;
- Minister of Education, Mr. Bytyqi's rival has tolerated the functioning of the AKA without the existence of the Anques Commission in this institution, in open opposition to the Law for General Administrative Procedure. 05 L-031), Net 125-135 respectively. Denying High Education Institutions, in this case also the College I The SPE, the Constitutional Rights to exploit all legal means against judicial and administrative decisions which violate its rights and interests in the way prescribed by law (Nani 32 of the Constitution of Kosovo).
- The actions of Minister of Education and today's AKA decision to abolish accreditment for College Research Programs I SPE, without any legal basis, is in direct opposition to the European Convention on Human Rights, respectively to Protocol 1, Article 2 (Eight for Education) which envisions that “deserts cannot be denied the right to education”.
- Minister of Education Mr. Bytyqi has made flagrant violations of the Law for Higher Education in the Republic of Kosovo and the Law for Prevention of Conflict of Interest in the Army of Public Function by not taking action against some members of the Agency Board who have made TV marketing in favour of certain institutions of private higher education and continue to be an active part of certain institutions.
- Even after the former AKA Adviser's request for the General Auditor of the Republic of Kosovo, where it is clear that because of allegations of irregularities based on decisions made by the AKA, it officially requires the carrying out of a general and comprehensive audit in the AKA, the minister of education fails to react and, in response, dismissed the duty U.D.D.'s commission.
Requesting from:
- Prime Minister of the Republic of Kosovo Mr. Ramush Haradinaj to take immediate measures with the Ministry of Education. Mr. St. Bytyqi and for once and for all to stop these arbitrary practices at the expense of their institutions of higher education, students and parents, while openly favouring several other institutions of higher education;
- The Kosovo Assembly calls for a parliamentary intervention, the minister of education for its actions and inactions, in relation to the AKA;
3 / 1 We seek from the chief of the EU Office in Kosovo, Mrs. Apostolova will immediately take action to initiate auditing (to officially request from the Court of EU Auditors) the way EU funds are spent in the education sector in Kosovo (Mr. Apostolova days ago declared that EU funds spent in Kosovo in the education sector total 34 million euros. We're also looking for Mrs. Apostolova will officially request from the European Agency (OLAF) specialising in investigating crimes committed against budgetary finance and corruption to initiate investigations concerning the spending of these funds in Kosovo in the education sector.
- We seek from the Kosovo Accreditation Agency to immediately withdraw this arbitrary and illegal decision and thus disrupt the cause of the already inevitable consequences to College I BOPE. Also, College I SPE suggests that it will use all legal means to put individual responsibility to each AKA official, who by his actions or actions has been part of these arbitrary and illegal acts.
College I SPE wants to assure all its students and students' parents that they will take all legal measures to ensure the management of the education process and will also keep them informed of any further action, including response through protests to the realisation of our legal rights.
