Since this minister had once rejected this request, Berisha has filed suit, demanding that this pension's right be recognised.
On this issue, on Monday in the Department of Administration of the Constitutional Court in Pristina, hearings have been held where this indictment has been reviewed, the Justice Vow reports.
According to Berisha's representative, lawyer Bedri Gashi, indicted Berisha when he was 5 years old during the war had lost his left-hand fingers as a result of a grant, adding that since then the overall state of health has not been good.
But according to Gashi, the Ministry of Labour and Social Management had unjustly rejected the pension demand, demanding once again its approval.
This session did not include any representatives from the unknown, MPMS, while Judge Hajriz Hoti stated the same had accepted the invitation, but in no way has he justified the absence.
The indictee also according to Judge Hoti, except for the response to the indictment, has delivered no evidence concerning the case, so it is mandatory that at the next session, which will be held on July 13, 2018, at 11:00, he will bring evidence to the case.
Armend Berisha had filed suit at the Administrative Department on February 15th 2017, against the Ministry of Labour and Social Management (MPMS), as it had rejected the request for recognition of the pension for permanent disabilities.
According to plaintiff Berisha, the MPMS had unjustly refused such a right, as according to him, both medical reports and examinations, had proved that the same has permanent disabilities.
As reported in the indictment, the plaintiff, on October 11, 2016, had received negative answers from MPMS regarding his retirement request.
Even after he filed a complaint, according to the indictment, MPMS had rejected him, arguing that indictee Berisha, does not have sufficient medical documentation for gaining this pension.
All that is said in the indictment is that Berisha, during the time of the 1998-1999 war in Kosovo, when he was five years old, fleeing with his family from Serb forces has lost his left-hand fingers.
According to the indictment, there are constantly various health problems, and as a result, he claims that he cannot accomplish any work.
