Confirmed indictment against 46 doctors in case “Stanta”

The court has rejected requests for dropping charges and rejecting evidence submitted by Gani Bajraktari, Sami Djoza, Faik Shatri and 43 other doctors, against whom the procedure was decided to be singled out in the initial review held in February of this year.

The news of “Justice Vow” has confirmed the Constitutional Court's spokeswoman in Pristina, Mirlinda Gashi.

“30,05,2018 has been awarded a verdict to refuse the request for the drop of the indictment and against the evidence”, the court's response said.

As for the third part of those indicted in this case, including some private hospital directors, doctors and other medical personnel, spokeswoman Gashi indicated, that she has not yet been decided on their requests for dropping the indictment.

“In terms of PKR.r.41/18, the court has not yet received a ruling in terms of the request for the drop of the indictment and the rejection of the evidence”, Gashi's response said.

Initially, in the “case Stanta” had been involved in 64 accused, but in the meantime, the prosecution had withdrawn from prosecution against Africa Bekteshi, while three separate judicial procedures were decided for other defendants.

Such a decision, the judge of this case, Shadije Grguri had taken it in the initial review held on February 26th of this year, due to efficiency of the case, as as the result of the large number of accused persons, this subject has been challenged to be handled in practice by the court.

So in the case now known as “Stanta 1”, former Prime Minister Ferid Agani and former Secretary Gani Shaban, in case of “Stanta 2”, Gani Bajraktari, Sami Djoza, Faik Shatri and 43 other doctors, and in “Stenta 3” are involved in the accused, Ali Hocaoglu, Mahmut Cackakm, Raif Cavolli, Borche Petrovski, Shpend Elezi, Blerim Zuna, Abdullah Tuna, Astrit Bakiqi, Dritton Sylejmani, Arton Beqiri, Lulzim Brovina and four private hospitals as legal persons.

State prosecutor on June 15th 2016 had filed charges against former Health Minister Ferid Agani, MS Secretary-General Gani Shaban and 62 other persons for criminal acts “the abuse of official position or authority”, “bribery”, “bribery”, “irresponsive medical treatment”, “The anti-law against legal activity and pharmaceutical activity <x>) and <x>

Meanwhile, the prosecution had resigned from prosecution against cardiologist Africa Bekteshi, arguing that the same was wrongly involved in the indictment.

In this criminal case, investigations were initially conducted against 116 physical persons and four legal persons. But for 56 physical persons, no legal conditions have been met to be included in this indictment, so the same investigations have ceased.

The defense of the accused has raised numerous dilemmas about the legality of this indictment, which they claim, in addition to containing unacceptable evidence it has been illegally raised by chief state prosecutor Besim Kelmendi. According to the defence, the State Chief Prosecutor's Office has no competencies in establishing the charges, as has happened in this case.
