In the act of about 30 pages, the tribunal's findings -- which influenced Krasniqi's acquittal -- are described in detail on charges of three criminal acts -- inciting hatred, inciting terrorism and avoiding taxes.

As for the first act, that of pushing to commit terrorist acts, the Foundation Court has found that none of the elements of the criminal act have been fulfilled.

“It is not contradictory that the accused in the quality of imam has kept speeches such as the Syrian Revolution and the assist Syria, but in the content of the same cannot identify any kind of appeal, recommendation or message, whether direct or indirect for pushing to commit any terrorist act, or attaching to any terrorist organisation”, it is written in the act of the Constitutional Court of Pristina.

Further in the act of the Pristina Foundation Court, compiled by Judge Becir Kaluldra, it is said that in all publications of Shefqet Krasniqi, described in the indictment, two elements are noted.

“S first his clear stand in relation to other religious beliefs by promoting tolerance among them and opposition as far as going to Syria and second, keeping these positions constant over the years, which shows that the content of the words -- the Syrian Revolution and the assist Syria -- does not contain any driving or stimulating element” -- describes Krasniqi's stances of the Constitutional Court of Pristina.

Further in the bias, witness statements given in the process towards Krasniqi are analysed.

If we refer to witness statements, one of them, Suad Mustafa, has stated that his brother Ilir went to Syria in 2011, that is, before the period Shefqet Krasniqi was charged with, so as such a testimony is unrealistic”, the court argues.

But concerning witnesses of this process, the Constitutional Court has found that two other witnesses, Nasere Ademi and Minire Heta, have offered no incriminating evidence.

“From the testimony of two witnesses, Naserne Ademi and Minire Heta, no element can be proven because witnesses speak of what they think could affect, which in this direction should be understood in the vicinity of those who have become part of those conflicts, the pain caused by that departure, and the need to find the reason why their relatives have become part of those <x1 developments, is said further in the act of prejudice.

In reasoning of the indictment, what the two witnesses said could not serve as evidence.

This is not enough and no case can serve as proof that the same has been influenced by the accused, Shefqet Krasniqi”, since the trial has been passed.

And in connection with these two witnesses, the court's judgment highlights another important element regarding their family members who ended up in Syria.

It is important to say that both witnesses have claimed that their relatives were part of other environments, as is the case with the Ministerial Witness who has claimed that her son Brian has gone to speeches and religious meetings in Macedonia, while witness Nasere Ademi has shown that Venera was part of an association and also that the son of the Venice Court has gone to Syria a year before she travels to that country and that the letter that Venera left has been in similar contents with the letter of the boy, thus showing the possibility of their relationship and that it has been influenced by the same act of the Constitutional Court of Pristina.

The last part of the act of prejudice refers to the act of avoiding taxation. Regarding this act, the court has found there is no evidence that Shefqet Krasniqi has declared false evidence concerning his business activity.

The trial of all administered evidence has not first confirmed the element that accused Shefqet Krasniqi has declared false data regarding his business activity, or that he did not include information about his income, wealth, economic status or other relevant facts for the assessment of obligations that are the key elements, and that must be proven to the second element that this is meant to be done in order to hide or avoid the payment of tax duties<1x>, the court's act is said to be rendered.

Pristina's Constitutional Court on 23 March this year acquitted Krasniqi of all charges.

Krasniqi was accused of pushing for terrorism, inciting hatred and avoiding taxes.

The indictment claimed that the push to carry out terrorist acts has been carried out between 2013 and 2014, while the crime of tax evasion carried out between 2011 and 2016.

Always according to the indictment, Shefqet Krasniqi, in the quality of the large mosque imam “Mehmet Fatih” in Pristina, has consistently and deliberately distributed messages to the public. Through his direct presentations to the public through various speeches, as well as by exploiting social networks and other information tools, through the rude language and the interpretation of Koran verses outside the time context and the principled Islamic spirit, has led others to take the path to the conflict zone in Syria and Iraq and then commit terrorist acts.
