Xhaferi warns Ivanov: The Albanian language law goes into effect without your signature

The law in question in May was again voted in Parliament, as it was not decreed earlier by State President Gjorge Ivanov, who, even after the vote, still refuses to decree it, with the reason it is unconstitutional.

Speaking of the Law on Use of Languages, Macedonian Parliament Speaker Talat Xhaferi, in an interview for the Turkish news agency Anadolu Agency (AA) says the parliamentary democracy system also envisions alternative opportunities for the breakthrough from this block of law.

As Xhaferi points out, ” The country's constitution sanctions the possibility that the head of state for specific bills, voted in Parliament, has the right to veto certain issues, but, according to him, does not imply that the president has absolute veto”.

He recalls that the constitution makes it clear that, in revote, after the return of the law by the head of state, it is obliged to sign the decree to declare the law in question. The head of the state and the head of parliament are together two people who decree the act for the declaration of laws, but according to Xhaferi, “Parliament has lawmakers and, according to constitutional logic and parliamentary democracy, the will of the Parliament cannot affect any other institution, regardless of the possible competencies it has in this direction, they wrote.

He stresses that the law could be addressed even without the signing of the head of state, in this case without President Ivanov's signing.

“For the fact that the head of state has only the competence of veto at a certain time, this means that the head of state with its decisions cannot affect the work of Parliament, and in this direction I think the way is for the law without the signing of the head of state to address the Official Journal, so that it can issue the law and then other constitutional institutions that have competencies against the dilemmas that have the head of state for the law”, Xhaferi said.
