Following the first investigations, the Ombudsman, Hilmi Jashari, has said they have noticed many violations in the process of deportation of six Turkish citizens.
According to him, deporting “Gylenists” without placing them before the courts was the first violation. In “Express Intervisten” on KTV, Jashari has said that even if the court were to decide on deportation, Kosovo would have to take into account the decisions of international courts, which have voiced against such deportations.
Whatever's most important, in such procedure when someone is accused of threatening security, he must appear before the courts. Whether there is interest or reason to expel someone, after a normal judicial process it is found to be expelled or not. If the judicial decision is made to cast a person out, there should be confidence that the outcast is not expected in certain dangers in the host country. The international court has found that in Turkey there is danger to the outcasts, and this has had to be taken into account. It is considered a violation when it returns to the site where there is danger of poor human treatment”, Jashari has indicated.
Jashari has also announced that Turkish citizens have rejected deportation orders several days before the deportation at the end of March. According to him, it was not lawful for them to take advantage of the complaint.
According to the first information, Jashari has said Turkish citizens have had residence permits in Kosovo, and not as it had been declared that these permits were already expired.
Yasar has also said that Kosovo cannot be indicted at the European Court, as it is not yet a member of the Council of Europe. According to him, if it were and found that Kosovo has committed violations, Kosovo would have to pay compensation, according to the decision. He has voiced hope that members of the families of expelled citizens will exploit the Constitutional Court to see whether their rights were violated or not.
