Red: Constitution not implemented on Kosovo territory

In an interview given for the Arbresh portal.info, Kuci says the constitution has had three types of challenges -- the first in the second legal character in political character and third in the state dispute, which it says has not been implemented throughout Kosovo's territory.
Koci has also mentioned Ahtisaari's package has had two balances that were not respected by the Serb community in Kosovo.
Ahtisaari's “The second has not been achieved, and ethnic rights balance is seen as at certain moments being misused by the Serb community”, Kuci has said.

It has been 10 years since the drafting and adoption of the Kosovo Constitution, how did you comment on it after 10 years?
At the time of drafting the constitution, we have taken into account respecting the will of Kosovo's citizens for sovereign and independent states, as well as respecting the Ahtisaari agreement.
I think we have come together two well intentions and have drafted a constitution that has been functional for ten years built on the basis of the functioning of Kosovo institutions for fulfilling state institutions, but also building new laws in Kosovo.
Do you think there should be changes in the Kosovo Constitution based on the circumstances we are today?
Of course, life is evolved that norm, and in that sense we have always been careful to respect the evolution of life for eventual changes. But what I can say, The DNA of the constitution that can be linked to values that protect them with order and law with democracy, human rights, independent agencies and many others I think will stay in the future. Other issues are political that can make the political subjects at a certain moment of their thinking about functioning and governing the country.
What have been the challenges facing Kosovo's Constitution?
The constitution has created a good mechanism for institution building. We had three kinds of constitutional challenges. The first challenges have been of legal character, the second challenges of political character, and the third challenge of state conflict. The first two challenges have often and well been addressed to the constitutional court, while the third challenge concerns implementation of it on the entire territory of Kosovo.
How much has the constitution been respected on the entire territory of Kosovo?
We need to strengthen the judicial vision of the constitution for order and law and values that this constitution protects, while for the way management and agreements on how to manage the state are political agreements. But the DNA of the constitution will not change for years, other issues are cosmetic that at certain times society decides.
Ahtisaari's package has envisioned two balances, ethnic rights balance and territorial balance of the exercise of sovereignty. This second has not been achieved, and ethnic rights balance is seen as at certain moments misappropriated by the Serb community. Here there needs to be a new agreement, primarily with international partners then even with the Serb community guaranteeing the possibilities for not constitutional change only for their vital interests listed in the constitution, but on other issues they should not have that opportunity. I think this is a period of revision and negotiation between Albanian and Serbian political subjects in Kosovo.
