Even four months after the Constitutional Court's verdict was declared, Eulex prosecutors do not know whether to file a complaint or not against this act.

Eulex spokeswoman Donika Berisha has told Periscope that the prosecutors of this mission are in the process of assessing the decision made by the tribunal.

“Linked to the release of former Minister Limaj in the case of MTPT EULEX prosecutors are currently in the process of evaluating the decision taken by”, Berisha has indicated.

Fatmir Limaj's defender, lawyer Tahir Rrecaj, says it is exclusive and the prosecutor's case to decide whether there is reason to file a complaint or not.
The case says the defense took the Act of Constitutional Court more than two weeks ago. According to him, the prosecution has the right to file a complaint 15 days after taking a plea from the first instance.

However, he estimates that the prosecutor of the case has no legal reason to file a complaint against the legal court's liberating judgment in Pristina in the MTP case.

I consider that there is no legal reason, but whether it is in the prosecutor's authority to decide whether to file a complaint or not”, the lawyer Rhecaj said.

However, he says that for all three cases, including the “Kleka” case for which the indictment has been handed over to the tribunal, Deputy Prime Minister Fatmir Limaj will seek compensation when these decisions become all-powerful.

“For all cases, even “MTPT” and the case known as “Bellanica” for war crimes are not yet cut. In the case of “Bellanica” we have not yet made the decision, of course we will ask for compensation of the damage even for these two cases, especially the MTP case, which has lasted eight years and seriously damaged Limaj's credibility, but we must wait until there is a bias to take it in a formal form”, Rrecaj said.

Lawyer Rrecaj says the indictment for damages in the case “Klica”, which was handed over to the tribunal last year, still does not have any moves on the part of the court, and Limaj is waiting for the tribunal to call.

Otherwise, after eight years of judicial procedure, the Pristina Constitutional Court on November 24th 2017 declared it innocent of all points of indictment, former Transport and Telecommunication Minister Fatmir Limaj.

Limaj and the other indictees in this case, cabinet chief Andrew Shala, procurement chief Naser Krasniqi, company owner “Talli” The Telaku rescue and Limaj's driver, Florim Zuka, have been tried for corruption in the Ministry of Transport during the time Limaj has been minister 2008-10.

Also this month, the Constitutional Court in Gjakova has acquitted Fatmir Limaj of the case known as the “Bellanica”, in which Limaj was charged with the murders of two Ramiz Hodza civilians and Selman Binish. /Periscope
