Unlike other positions that are part of the memorandum signed between the chief parliament, Kadri Veselin and British Ambassador Ruari O'Connel, in which the embassy is scheduled to participate in the candidate recruiting process, there is a different procedure for the Commission for Jurisprudence.
This commission is proposed by the justice minister, without the recruiting procedure. Annie why this is a different process, based on a memorandum, institutions would have to inform the British Embassy, which has not been done.
The Commission for Proving Jurisprudence is one of the positions agreed between the Embassy and the Assembly with the memorandum of co-operation.
British Embassy told Gazette JNK that the proposal was made without their knowledge.
“The selection of the Commission for Proving Jurisprudence has been on the list, but we haven't been engaged in selection. The process has continued without the commitment of the implementing partner”, it says in their response.
And Justice Minister Abelard Tahiri says the name proposal is his comment, and no recruiting procedure is under way.
The <x0morandum that you refer to and which connects to ensuring transparent and merit processes of recruiting high-level leadership positions in the sense of the Law for Civil Service of the Republic of Kosovo, applies to or can be applied to relevant positions in the civil service where the recruiting procedures are carried out (competitive, application, written and oral testing, selection and nomination proposal) but not in cases where the legal responsibility of the justice minister (as in concrete case) and so much so that the members in this commission are not required to be so much civil servants, the more under way that the higher procedures are not carried out, Tahire said.
The newspaper has asked the embassy which list has been compiled with positions in the memorandum, in order to explain why this commission has been introduced. They have told us the list is agreed on by the signatory parties.
The “Morandum signed with the Parliament contains a list of specific positions that will be covered by this project, these previously agreed positions with the Speaker's Office of the Assembly. We will expect the Assembly to announce relevant institutions regarding the memorandum.
Justice Minister Abelard Tahiri has nominated the Assembly for five, respectively, ten names for the commission to give the jurisdictional exam. On February 1st 2018, the government, with a proposal by the Justice Minister, prosecuted the names of members of the Commission for giving the jurisdictional exam. 20 days later, the Commission for Legislation examined the names and prosecuted them in the Parliament. There are five names for members, and five others for deputy members who were voted by the Assembly for the formation of the Commission for the exam on jurisdiction. The Assembly has approved this commission. 73 deputies have voted, out of 55 have voted for, 14 against, and 4 have abstained.
