Switzerland expels Kosovo for a very interesting reason

A 31-year-old person with Kosovo citizenship who has lived almost his entire life in Switzerland but who has been deported to Kosovo because of the many deltas, once will not have the right to come to Switzerland, despite the fact that he has a wife and a common child, writes Tagblatt.ch. Kosovar had come to Switzerland when he was only 6 years old and in time had received permission to stay (Viza C) at Canton St. Gallen, broadcast albinfo.ch. But because he violated the law several times, the Migration Office in 2012 had refused to continue his residence permit and deported him to Kosovo.

He, from 2001 to 2010, was sentenced 9 times for various criminal acts. The worst sentence had been pronounced in 2007 by the Alttogenburg District Court, when he was convicted of robbery, threat, forced effort, beating, breaking of domestic calm, violation of the law on weapons and delices in communications, broadcast albinfo.ch. For all these criminal acts, he was sentenced to four years in prison on bail and a fine of 2,000 francs.

Because of the large number of criminal acts, the Federal Bureau for Migration and the Federal Administrative Court had assigned him a measure of ban on entry into Switzerland until September 2022. Meanwhile, Kosovo's wife and son have been demanding a long time ago that he be allowed to come to Switzerland within the family union.

But the Cantonal Office for St. Gallenite has rejected this request with the argument that there is still a danger that the person in question would return to earlier criminal behavior. From around here from Canton St. Gallen and the Administrative Court have been found to pose a further threat to security and public order.

The wife and son of the mentioned have already earned Switzerland's (passport) citizenship, and afterward they have turned to the Federal Court with the reason that this constitutes a new element even with regard to their father's mate, a change that should be taken into account. Especially should there be consideration for the child's interest.

The Federal Court has rejected this request. But she has made it clear in her decision that the cantonal authorities in case of another requirement for family reunion appreciate whether the mother and child's private interest in having a common family life should weigh more than the public interest in keeping away from their father. In this case, it must be taken into account that the prison sentence of 18 months on bail and Kosovo's last delta -- a car race that has caused an accident with a third injured -- has already spent ten years.
