Court brought down indictment against former head of Z-Mobile Telekom

The indictment against former Kosovo Telecom leaders Agron Mustafa, Ejup Qerimi, and Raja Gjonbalaj is dismissed. News of Calxo. com has informed lawyer Artan Cerkini.
According to the lawyer, the Constitutional Court has taken the claims of defenders to challenge evidence and drop the indictment in a way that has rejected the indictment filed by the Special Prosecutor.
In the case of making this decision, the Court has directed the damaged company “Dardaphone.net”, in civil conflict.
On September 27th of this year, all of the accused had been declared innocent in connection with charges being placed in bars.
The indictment has been representing Special Prosecutor Florie Shamlli, while the case has been tried by Judge Lutfi Shala.
According to the indictment, defendant Ejup Qerimim during the February 2012 period, exploiting the post, respectively, has failed to fulfill its official duties in order to cause material damage to someone else. With these actions, the defendant committed a criminal offence, “misusing official position or authority” by Article 422 paragraph 1 of KPRK.
Meanwhile, defendant Agron Mustafa from 19,02.2015, when he took over the leadership position until the time of 24.05.2017, when this defendant, although not competent, had linked the deal to executing the final decision, defendant Agron Mustafa using office, respectively, has failed to fulfil his official duties in order to cause material damage to another company. With these actions, the defendant committed a criminal offence, “misusing official position or authority” by Article 422 paragraph 1 of KPRK.
Also, in the indictment of the Special Prosecutor of the Republic of Kosovo, it is stressed that third defendant Raja Gjonbalaj, using his official duty, has failed to fulfill his official duty in order to cause material damage to someone else. By these actions, defendant Rexhe Gjonbalaj has committed a criminal act, “misuse of official position or authority” by Article 422 paragraph 1 of KPRK.
KA LLXO.com learns that the indictment involves actions that precede the court's decision and then the arbitration dispute, which ended with the agreement between Z-mobile and Vala.
Agron Mustafa and Ejup Qerim, at different times, have held the position of Telekom's chief. Meanwhile, Rexhe Gjonbalaj has been chairman of the Kosovo Telekom board.

On May 24, 2017, Kosovo Telecom and Dardafon ( Z-Mobile) reached agreement to close the arbitrage decision about the contract for virtual mobile phone operators.
The decision was presented as a triumph for the company after releasing the telecom from the 30m-euro payment obligation to Z Mobile company.
In 2016 the arbitration court had ruled in favour of Z Mobile Company in the conflict with Telekom. The decision created a commitment to compensate for a 30m-euro damage.
Immediately after the decision, authorities and people of justice had reacted, demanding investigations and responsibility for this loss.
Bloods had calmed several months later when Telekom and Z Mobile agreed that the decision on paying 30m euros would not be implemented.
