Prosecutor Hajdari alerts: The Act in Proto case is expected to be rejected

Special Prosecutor Drita Hajdari has raised doubts in the case “Proto”, which she is investigating.

According to her next session in the “Proto” case, set on December 21st, it may also be the last.

In an answer to Ktv, Hajdari has said there are information based that the indictment against Adem Grabovci, Minister Besim Beqaj and other indictees in the case “Proto” will be dismissed.

Prosecutor Hajdari has given this statement following her refusal to demand Judge Shashivar Hoti's exemption from the trial of the case.

My doubts about the objectivity and impartiality of Judge Shashivar Hoti were raised because he had previously warned the defendants that they have the right to agree not to read the indictment, even though the law stipulates that in the initial review the prosecutor reads the indictment. Also, my suspicion is based on some information that the indictment in this case will be rejected at the next session”, she said.

Prosecutor Hajdari has even said that defendants have the information that the indictment will be rejected.

This information is undoubtedly the defendants who have entered the courtroom, as they are entering the Kosovo Assembly Hall, welcoming “Proto”. For this reason, I sought the expulsion of Judge Shashivar Hoti from this case. I'm very sorry I said I can't trust the judge, who, contrary to the law, doesn't allow reading the indictment and to which defendants come as in “aheng”.

Pristina's foundation court has nominated prosecutor Hajdari's request for the expulsion of Judge Shashivar Hoti.

In a written response to this court, Pristina Foundation Speaker Aferdita Bytyqi is said to have named the prosecutor's request unbaptised in law.

In the concrete case, in the request filed by Prosecutor Drita Hajdari, prosecutor at the PSRK, no circumstances have been presented that would justify the expulsion of the chairman of the Judicial Chamber from prosecution and the deployment of this criminal case as envisioned by the provisions of KPP Article 39. Hence, the Court Speaker found that the request is unsubstantiated in law”.

The Special Prosecutor, in April of this year, filed charges for criminal activity “The violation of equal status of citizens and residents of the Republic of Kosovo in co-ordination”.

The second review session against the accused in the “Proto” case is December 21st.

The newspaper Insander has long ago published wiretapping where Grabovci and others are heard discussing people's employment based on party preferences.

Among them was prosecutor Bahri Hyseni's appointment as a member of COST, without any criteria.

They had also acted on selecting board members in Prizren's Aqua, where the only criterion for Nijazi's Grabovac was the political party.

The wiretapping confirmed full control of PDK officials in public enterprises.

Adem Grabovci and Besim Beqaj had received full powers from Hashim Thaci, who at the helm of three public enterprises, PTK, Infrako and Traiko were deployed to people representing their interests. A series of wiretapping of Grabovci and Beqaj testify to these plans that were finalised with appointments.

Two years after these wiretapping were published, the Prosecution filed charges against 11 persons involved in the Proto case.
