Mother relates how her father kicked the 14-year-old boy in Karacheva

According to the indictment, Bernjeshi, by his cruel actions, has killed his minor son after a beating he had inflicted on him on the night of May 23rd of this year.

After reading the indictment by prosecutor Shaban Spahiu, the court panel led by judges Aziz Shaqiri chairman, and Naser Maliqi and Veli Kryeziu's member, urged the defendants to plead about accession or not guilt.

After the end of the opening word of the parties, the trial continued with the questioning of witnesses.

At this hearing the testimony provided Safete Bernashi, the accused's wife, Naim Bernashi, the accused's daughter, and finally his brother, Muharrem Bernjashi.

Safete Bernjeshi during her testimony stated that she stands by the statements previously issued at the Prosecutor.

Then she confessed to the incident on the critical night.

The trial further continued with the questioning of witness Naim Bernjashi.

It detailedly described the critical night situation.

Naim relates that by coming home from school, about 8:00 a.m., she had heard some voices coming from her house.

I've heard a voice in the form of screaming from my house, but I haven't noticed whose voice it is. When I got into the house, I saw the brother who had some marks on him and that the same guy had no clothes on, and when I got into the room he was standing up and I asked him what was done, and he didn't say anything. Then, when he's back inside, my dad's beating me a little bit, Mahma's witness cried.

Naim further indicated that when her father first returned home with a black plastic intestine in his hand, he addressed her with the words: why did you take money and beat me a little bit, hitting me with this intestine and the one where he could have <x0...

Among other things, she declared that then <x0baba became convinced that I took the money, started beating my brother, and I heard him say, "Why did you take the money, and my brother never knew he took the money? I've heard the brother screams from the beating my father gave him”, declared witness Naim.

During her testimony she also indicated the moment she went to her brother's room after her beating and poor health in which she had seen her.

I went into the room where my brother was, and I saw that his condition was worse and he asked me to fuck off and after I took him out he started vomiting. And after I got it back into my room I noticed there was blood on the back of his head that I cleaned with a bandage, and when I cleaned his blood, he didn't communicate with me”, the witness said.

She further stated that in four or five minutes, I saw my brother get worse and his pulse is so weak.

I called him by name, he didn't answer me, and his breathing was harder. Then, I called my father and I told him, "Come and take me to the doctor, and after he doesn't drive at night, we've gone and called the uncle, Muharrem Bernjeshi. And when Uncle Muharrem got out, his father told him that I was a bad guy and he fell off on a motorcycle. This is because my brother fell on a motorcycle is to say it because if he said something I had to do the same, I probably did it out of fear of”, Naim Bernashi said in her confession.

Finally she claimed that her father had worked as a beggar and before the critical event took medication for calm and that because of high blood pressure, she had stayed in the hospital about a year ago.

Finally testified to Muharrem Bernashi, who told of the critical incident of what had happened since his niece Naim and Brother Ganiu had gone to the house to offer help to send Ganiu's son to the hospital.

“Ganiu told me that the boy had a motorcycle fight and when I went home, he told me that the boy died”, confessed to the witness.

The Witness then related how when Ganiu's car was returned from the Kamenica hospital, where the boy's death had been recorded, leaving his car in his garage, had seen the engine in the garage without a defect, grave, or scratch.

When I went to leave Gani's chair in the garage, I saw the engine there, and so I thought it wasn't possible for the boy to fall on a motorcycle, because in such situations when the engine went down, he got shot down, and on that day there was rain and there was engine coming down and there was mud but there was no”, said Muharremrem Bernjashi.

This witness further indicated that during the time he drove the boy to the hospital, Ghaniu spoke nothing and was not worried at all, explaining that he did not yet touch his son or even talk to him at all.

In the question of Judge Naser Maliqi, of what caused the death of Ganiu's son, the witness responded by stating that “the boy died from blows from Ganiu's”.

According to the prosecution's indictment, Gani Bernashi is accused of committing a serious murder because on May 23, 2018, at his home, deliberately deprived of life in a cruel way, his minor son, 14 years old, in a way that after asking for clarifications concerning the lack of some money worth of 1,500 euros and failing to take the answer for it, has first hit him with a plastic-gyp water rod, and then with a wooden stick in the form <x0log> to the head and other parts of the body, respectively, and sometimes from the hour to the 1100 hours of a deadly wound.

According to the prosecution, defendant Gani Bernjashi, after noting that his son is losing his life, called his brother asking for help to send his son to the QKMF in Kamenica, telling him that the boy was hurt by the driver's motorcycles. Upon arriving at the hospital, however, the doctor had found that the victim had already passed away.
