Today, I have sent accredited ambassadors and Kosovo Liaison Office officials, facts letters and arguments listed for the Government of the Republic of Kosovo's decision to set the 100% measure for products imported from Serbia and Bosnia and Herzegovina. The letter has the following contents:

On November 21st 2018, Kosovo imposed 100% customs duties on all goods imported from Serbia and Bosnia and Herzegovina. This decision has been made in accordance with Article 18 of the Central European Free Trade Agreement (CEFTA). The decision is a response to Serbia and Bosnia and Herzegovina's continued destructive actions seeking to undermine Kosovo's sovereignty.

The Republic of Kosovo strongly believes that dialogue based on good will, mutual respect and good faith is the only way to build trust between states and peoples, promoting long-term peace, strengthening regional stability and increasing prosperity.
Therefore, the Kosovo government is strongly devoted to reaching a long-term comprehensive peace agreement with Serbia, which addresses all political, security, economic, trade and cultural issues.

Kosovo has consistently and firmly implemented all its international obligations, including CEFTA and its SAA, and will continue to do so.

The Kosovo government calls on EU representatives, as mediators in the dialogue between Kosovo and Serbia, to force Serbia and Bosnia and Herzegovina to meet their commitments under CEFTA and other agreements.

CEFTA's Article 18 allows its members to take any necessary action for “protection of essential security interests or for implementing international obligations or internal policies”. Serbia, supported by Bosnia and Herzegovina, constantly and actively tries to undermine Kosovo's security, sovereignty, independence and territorial integrity. Its actions violate mandatory legal and political pledges, including the Brussels Agreement on normalisation of relations. These actions threatened the basic security interests of the Republic of Kosovo.

Among the latest, such actions are the following:
• Serbia's campaign to pressure countries to revote Kosovo recognition.
• Serbia's successful effort to sabotage Kosovo's INTERPOL membership bid, which was also supported by Bosnia and Herzegovina.
• Physical attacks, ignored by Serbian law enforcement bodies, Kosovo transport vehicles and Kosovo citizens, using the territory of the state of Serbia as a transitor in other European countries.
• Arrests, threats and other criminal acts by Serbian representatives towards ethnic Serb members of the Kosovo Security Forces.
• The violation of the participation agreement in regional organisations and initiatives by denying the official representatives of Kosovo (including members of parliament, ministers and senior representatives of the Government of Kosovo) the right to participate in organised events in Serbia and Bosnia and Herzegovina.
• Kosovo sports federations and artists deprived of the right to participate in international competitions.

Serbia, Bosnia and Herzegovina have repeatedly violated CEFTA and have not responded to complaints brought by Kosovo. Kosovo has strictly maintained CEFTA conditions. However, the actions of Serbia and Bosnia and Herzegovina have made it futile to create a legitimate free trade zone. Recent violations include:
• Serbia has deliberately rejected the Integrated Border Management Agreement, while refusing to exploit EU-funded border objects, causing 12m euros in losses in funding donors for Kosovo
• Serbia refuses to honour agreements on customs procedures, including those related to customs stamps. As a result, Serbian products are entering Kosovo without paying customs and T tariffs VSH, deprived Kosovo of revenues and enabling anti-competitive advantages for Serbian products.
• Goods from Serbia and Bosnia and Herzegovina especially food and construction materials receive additional illegal state aid and have been illegally broken up in Kosovo, further disrupting the domestic market.
• Kosovo products do not have access to the Serbian and Bosnian market or face different non-tariff barriers. For example, the Serbian and Bosnian authorities:
Or abuse the Sanitary Certificate process and win the Sanitary by taking samples from every drinker's truck, compared to the standard inspection practice of 3-5 trucks per 100.

Or they don't know the tests for testing Kosovo exporters.
Or reject granting licenses to specialised goods made in Kosovo, such as pharmaceutical products.
Or refuse to recognise the certificate of origin issued by Kosovo authorities and demand a confirmation of the origin of goods that will be issued by a Serbian authority, violating Kosovo law, Serbian and Bosnian law and CEFTA.
• Serbia imposes transportation barriers that seriously block or delay the import of goods in Kosovo from the EU. As a result, the volume of Serbian goods sold in Kosovo is non-professionally higher than Kosovo goods sold in Serbia, even when they have adapted to market production and size.
• Kosovo trucks are not allowed to use Serbia as a transit on the EU market.
• Similarly, Bosnia and Herzegovina exports significant volumes to Kosovo, while placing extreme non-tariff barriers to imports from Kosovo.
• Kosovo companies are not allowed to compete in public bids in Serbia. On the other hand, there are more than 100 public bids that Serbian companies have won in Kosovo.
• Serbia has refused to implement the 2013 Energy Agreement, which was confirmed in 2015. As a result, Kosovo's government has suffered direct losses of over 30m euros a year, and Kosovo businesses have lost 300m euros annually.

CONDITIONAL
The Republic of Kosovo is dedicated to the principle of free trade. However, free trade requires mutual respect, real co-operation and reciprocity. The Republic of Kosovo for many years has demonstrated considerable patience in the face of growing hostility and provocation. The tariffs imposed on November 18th are the inevitable result of such actions.
