The new Penal Code, which is in the procedure for approval by the Parliament of the Republic of Kosovo, has brought innovation in punishing drivers who drive drunk vehicles.
According to the new Penal Code, anyone driving a vehicle unable or under the influence of alcohol if there is alcohol in the blood over 0.5 gg, is fined or sentenced to imprisonment of up to three (3) years.
Unlike this code, the penal code in effect did not presuppose the amount of alcohol in the blood, writes colxo.com.
It says:
“Anyone who drives the vehicle unable or under the influence of alcohol or other intoxicating substances is fined or sentenced to jail for up to three (3) years“.
Except for this point, which differs from the current penal code, the other points from this article are the same, and in them it comes down to:
If criminal activity by running an disabled vehicle or under the influence of alcohol results in a person's slight bodily injury or property damage worth five thousand (5,000) Euro or more, the chief is fined or sentenced to imprisonment of six (6) months to five (5) years.
If criminal work by running an disabled vehicle or under the influence of alcohol results in a person's severe bodily injury or property injury worth twenty thousand (2,000) Euro or more, the chief is sentenced to jail time of (1) eight years.
If criminal activity by running an disabled or under the influence of alcohol results in the death of one or more people, the chief is sentenced to prison for three (3) to 12 (12) years.
