Kosovar had arrived in Switzerland in 1991, 27 years earlier, along with her husband and had sought asylum without success. A world, in parts of the former Yugoslavia, war was raging, so Kosovo could stay even further in Switzerland. In 2006, it was temporarily accepted.
Today she is divorced, and her three children, aged 36 to 24, are naturalized. The woman was married at 18 and two years later gave birth to her first child. In her homeland, she had only attended school for five years and had not completed any training.
In its complaint, Kosovo relies on Article 8 of the European Convention on Human Rights (KEDNJ), which guarantees the right to respect private and family life. However, the Federal Court notes that it cannot be observed any right to prolong its permit from this article, Albinfo.ch reports.
In view of her personal circumstances, such a claim was not clear. That's why she had to do this more concrete in her complaint.
Instead, the court refers to the lower court's reasoning, under which despite many years of stay in Switzerland and despite considerable income capacity, a professional-economic approach has been lacking, as well as a language integration.
Starting in 2007, Kosovo has begun receiving social assistance, even after warning from the Law on Foreigners, released by the Migration Department in 2015. In this document, she was threatened with failing to renew her residence permit in case of further withdrawal of social aid. Between 2007 and April 2016, it was supported by almost 150,000 francs, as issued by the Cyril Administrative Court's ruling.
In the past, Kosovo had been working only in a formal way. She had personally declared that she could not work for health reasons, further informs Albinfo.ch.
An opinion by a 2007 security company described it as inappropriate to work for psychiatric reasons. On the other hand, the office of disability has refused two retirement requirements, reasoning that no health injuries have been diagnosed with it, and there has been no limit on work capacity, Albinfo.ch reports.
According to the Administrative Court act, Kosovar is socialised in her homeland and has a family and social network with mother, three brothers, a sister, and other relatives. In her homeland she travels once a year for 10 to 14 days. On the other hand, even after 25 years of her stay in Switzerland, she does not have sufficient knowledge of the German language and has been so modest that in a police interview an interpreter has been required.
Near the Federal Court, Kosovo is represented by a lawyer specialising in the asylum law by the Dyticion district.
