The Constitutional Court in Gjakova on Monday has sentenced him to two thousand euros in fines, examiner Luan Hadzishaban, after being convicted of misusing official office, who was charged with having received money to pass the theoretical exam.
As reported Justice VowHadzishaban was sentenced to six months in prison, but the sentence was replaced by a two thousand-euro fine, and was imposed on the injured Blendi Koci and Artan Ndau to compensate for the 300-euro amount he had received in case of committing a criminal act.
This indictment has been announced, as this court has initially approved the agreement to accept the guilt reached between accused and prosecutor Agron Matjani.
Under the agreement made on December 12, 2017, Luan Hadzishan was scheduled to be found guilty of criminal acts as in the indictment and be sentenced to 5 to 6 months in prison, which the sentence would be replaced by fines in the amount of 1500 to 2,000 euros.
The defendant's defender, lawyer Massar Vula, said the plea agreement was made in line with legal provisions, and without influence or pressure on the accused, so it requires that after her approval as such, the minimum of the prior sentence be pronounced on his client.
According to the indictment, Luan Haxisaban, was accused of being broadly in the 19 August 2016 driver's license centre in Gjakova, had misused his official duty with the aim of illegal property profit, so that in the position of the examiner -- questionnaires for the theoretical driver's license test, candidates Blendi Koci and Artan Ndau had received amounts of money from 300 to 400 euros in order to pass the theory test.
In this case, accused Hadzishanani has committed criminal work “misusing official position or authority”, from Article 422 of the Republic of Kosovo's Criminal Code.
