He was wanted by Serbia because of the launch of a threat, which according to Serbian justice has caused unrest in the football match between Serbia and Albania in 2014.
But the final decision will be made by the minister of justice, reports Croatian news agency Hina, broadcasting Koha.net.
Morina, according to the warrant, was detained in June this year on Dubrovnik territory. Serbia charges him that three years ago by conducting a fears that, according to Serbian authorities, there were nationalist messages reflected through the map of Greater Albania, why football was interrupted between representatives of Serbia and Albania in Belgrade, resulting in riots among fans.
The Dubrovnik District Court allowed its extradition to Serbia since this year's July, when it was concluded that judicial conditions have been met, but after Morina's complaint to the Supreme Court annulled that decision and the case returned for retrial.
Even in the rerun procedure, the Dubrovnik Court allowed extradition. However, Morina complained again, while the Supreme Court ruled that his complaint was groundless, respectively, that all legal conditions for extradition have been met.
But the final decision is made by the minister of justice, notes Hina, Tnamson Koha.net.
The biggest part of the person's complaint about extradition is essentially the wrong and incomplete proof of the actual situation since the contents of the complaint indicates that he considers that the first degree court has wrongly confirmed that the legal conditions for extradition have been met and that it has not proved there are obstacles to extradition. However, the first-instance court has confirmed all crucial facts directly and fully”, says the latest ruling by the Suprenem Court published today on the website.
The court has also found that, in the statement that Morina has filed in his complaint “, there can be no reason to assume that the person for extradition to the Republic of Serbia, only because he is Albanian and because of his political beliefs will be discriminated against during the trial, respectively, that there will be a difficult position of” for this reason.
His ruling should be handed down to the first-instance court in Dubrovnik, which then must inform him of everything -- the minister of justice -- that he may take the final decision.
According to an unofficial information, Morina has already sought asylum in Croatia, which could influence the final decision on extradition.
