Prosecutor complains of sentences in Badovci case

A little more than a month after finding fault and sentenced the arrested Badovci case to 18 years in prison on charges of pushing terrorist acts, special prosecutor Drita Hajdari has turned to the Court of Appeals dissatisfied with the verdict.

Last month's trial of the Pristina Constitutional Court convicted of pushing to carry out terrorist works, Besnik and Enis Latifin, Milam Hadziaj and Gazmend Haliti, while Fehmi Musa was convicted of helping to promote the performance of these works.

Hadziaj, Haliti and Enis Latifi were sentenced to three and a half years in prison in July, while Besnik Latifi was sentenced to four years and six months in prison. Fehmi Musa was sentenced to three years in prison.

Three convicts were accused of preparing terrorist acts, a work that was requalified in a push for performing these works.

Prosecutor Hajdari in her complaint to the Court of Appeals claims that redefining the criminal act from preparing terrorist acts to pushing for the conduct of terrorist acts is unstable.

“This prosecutor considers that the purpose of the accused was not to push other persons to carry out terrorist acts, but to commit terrorist acts directly on the part of the accused, which they also wanted to publicly swear to their leader for the implementation of his orders to sacrifice”, is said in the complaint of the Special Prosecutor's Prosecutor, who he has secured. Unlike prosecutor Hajdari, the lawyer of accused Besnik Latifi, Albana Kelmendi, said there is no criminal act in the actions of random persons “Bavci”.

“The defense agrees with the prosecutor over that in the actions of the accused there are no elements of the offense, because in fact there are no elements in the criminal act and the accused should be acquitted and released from charges”, reportedly in the complaint of lawyer Kelmendi.

These sentences pronounced by the Pristina Constitutional Court were easier compared to sentences pronounced in July 2016 when Besnik Latifi was sentenced to 13 years in prison, Gazmend Haliti to 12, Milazizim Hadziaj to 10 years and 3 months, Fehmi Musa to 4 years and Enis Latifi to 10 years in prison.

L3 close to convictions occurred after the Supreme Court of Kosovo retrialed the Badovci case, finding that the criminal work figure has not been met in preparation for terrorist acts.

According to the indictment, Besnik Latifi, Gazmend Haliti, Milazizim Hadziaj, Fehmi Musa and Enis Latifi, in July 2015 had gone to Badovci Lake near Pristina in order to record a propaganda video in which they planned to read the oath to the leader of the terrorist organisation “Islamic State”, known by Short I SIS.
