You have questions and you want answers to the U.S. Family Union? Lawyer Chiran Both gives answers to interested ones who ask if the process of family reunions has stopped immigration.
I have applied to bring my sister to America. I wanted to know if family union visas were temporarily banned, because I haven't seen any new information on the Internet. Thank you. SG”
There's a lot of confusion about visas because of all the news about immigration. Requests made for family reunions are as usual under way by the Migration and Citizenship Service (USCIS), and visas continue to be issued by the US State Department (DOS). The president's recent executive order imposes restrictions on visa issuing for the citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen. However, family reunification petitions continue their procedure for individuals from those countries. Visa requirements by citizens of other countries pass their usual process.
Applications for American Citizens' Brothers and Sisters
As an American citizen, you can help relatives become permanent residents of the United States by taking on a document called “Gren Card”. To do that, you have to sponsor your neighbor and prove that you have enough income or means to support him when he comes to America. Begin the process by completing and presenting the I-130 Form, (Petition for Alien Revelation). This form determines the family relationship that exists between you and her. A U.S. citizen who is at least 21 or older may seek family reunion with his brothers or sisters. When you submit your application, you are required to give evidence to confirm your relationship with the person you are making.
Priority Date
The I-130 form presentation and confirmation of the relationship with the applicant puts one's neighbor in line with others who expect to emigrate from the same country or region, based on the same family report. When your sister, brother, waits for a period of time, comes out next, is ready to emigrate once the search has passed and the fulfillment of immigration requirements for admission to this country. This process is carried out based on the priority date that means the date for presenting your request. The date has an advantage for the timing of completion of the process faster than others. This date, presented in the USSCIS notification, is marked as your “Data of priority”, or prior date. The waiting period has been calculated since this date. For family members of US citizens, including the US citizen's husband/wife, parents and children under the age of 21, there is no line. For other relatives, they must wait several years in a row because of numerous demands and restrictions on the immigration law on these cases.
The reader's request for his sister makes it into the category of F4 preferences. 65,000 visas are issued each year for the category F4. DOS has announced these times that it accepts documents for Form I-130 that have a priority date on or before November 15th 2004. Since August 2017, I waited in line for petitions submitted to my brother or sister is approximately 12-112 years. The current waiting times for the visa categories can be seen at “visa budgetin” on the State Department website at www.trvel.state.gov/visa.
Other Questions From Readers:
My father was approved for American citizenship. Can I get an American passport through my father?
You can automatically become citizens of the United States if you meet certain conditions. There are two ways to gain citizenship through parents: the first from birth and the other from birth, but before the age of 18. You can become an American citizen when your father is naturalized, but it anyway depends on the law that was in force at the time you were born. The law has changed over the years, but it usually requires a combination of a parent who is a US citizen with the time of his child's birth, and parents must have lived in the United States for a certain period of time. We suggest you consult a lawyer with immigration experience for such cases. There's enough to talk about gaining citizenship that we're going to address in future newspaper numbers.
