Serbian List Warns Effects in Non-formation of Association

Formation of the Association of Serb majority municipalities stems from the Kosovo and Serbia agreement under dialogue in Brussels in 2013, while in August 2015, Kosovo and Serbia have been writing the agreement on forming this association, also specifying the way they form.

Igor Simay, deputy of the Serbian List in the Kosovo Assembly, speaking of Radio Free Europe, emphasises that the political subject he represents, consistently insists on forming association, but according to him, the start of the formation process still does not appear on the horizon.

“We are not limiting the deadline for when we will start with this, from December, January or June. It means, this is the constant demand of Serbian representatives in the past four years, since the Brussels Agreement” was signed.

“This is the obligation, which Pristina has taken over, signing the Brussels agreement and this is binding not only on Kosovo Serbs and the official Belgrade with which the agreement was signed, but also on international representatives in Brussels, Washington and those who are here in Pristina”, says Singleness.

He adds that disrespecting the agreement promotes consequences in the sense of losing mutual trust, which depreciates any kind of further talks with specific political factors.

On the other hand, neither has the Government of Kosovo specified a clear deadline when the process of forming association will begin.

Even officials of this government have said days ago to Radio Free Europe that the issue of forming Association is not urgent and that “first needs to be drafted draft draft and then revised according to the Constitutional Court's verdict and the Brussels Agreement, as well as again that it must go once again for confirmation at the Constitutional Court”.

Just because the association should be formed in line with the Constitutional Court and the Constitutional Court verdict, the Serbian connoisseur of political developments, Randel Nojik, speaking of Radio Europe, says he sees the procrastination of this process on the part of Kosovo institutions unreasonable.

The moment this condition was met, the possibility of Belgrade further conditioning the resolution of several other problems with the formation of the Serb municipality community would be averted. I think Pristina in this case should show wisdom to solve this problem, normally, under the Brussels agreement, which clearly says the Serb municipality is formed according to Kosovo laws and that the Constitutional Court is obliged to declare constitutionality. If you look at all these acts, you will see that this community of Serbian municipalities will have no greater competence than they have today's local self-government”, Nojrik says.

He emphasises that all of these remain in the Brussels agreement signed in August 2015.

But, the Serbian List has already dismissed the possibility of the association being established under the August 2015 agreement, demanding that the association be formed under the 2013 Brussels agreement, which was signed by former Prime Minister Hashim Thaci, currently president of Kosovo.

This has also led to the freezing of communication between the Serbian List and President Thaci, Sim enemies point out.

This is one of the reasons, because there are more. But as someone who has personally signed that agreement, we consider that he is even the most responsible person for this” situation, Simpus points out.

But, Nojjic, suggests that the Serbian List is mistaken in this situation because according to him, the 2013 agreement provides only reconciliation in principle for forming association, while the August 2015 agreement specifys the conditions of formation.

The Constitutional Court of Kosovo, on December 23, 2015, had estimated that some of the general principles of the Association Agreement, reached on August 25th 2015, between Kosovo and Serbia, were out of harmony with the Constitution of Kosovo and that these principles should be in accordance with the constitutional standards of the Republic of Kosovo.
