Kosovo property division law change sought

Women in Kosovo are not rarely faced with problems as far as divorce is concerned. Many take nothing, and some take a small part, but this situation must change quickly and that it should not last any longer.

So says in an interview for KosovaPress, Luljet Aliu, who as citizens of this country, has taken an initiative to change the Family Law, specifically for recognising the equivalent of domestic labour, demanding that the law clearly determine, in case of separation, common wealth be divided into two equal parts.

This proposal, which she has already submitted to the Commission for Legislation and hopes her proposal will go to the session for review.

But for that, it needs the support of at least six deputies. She says that fair implementation of the law that is in force comes through and that for this women in Kosovo are severely damaged in the event of separation from the husband.

At times when marriage is entered, wealth is considered to be a mate's common asset, which is divided into equal parts. The purpose of this analysis has been to regulate the part of the legal practice, since right implementation of this concept is in place, and for that reason we are extremely damaging to women in Kosovo”, she says.

It calls all of this economic violence and that women for this reason are forced to remain in a dignified situation and not seek divorce. It says that the equivalent of work is one of the most fair and fair things women can ask for.

At the moment when the woman is seeking a divorce from her husband and goes to the Court, legal practice decides on common wealth in a very arbitrary way because it is not legally determined how common wealth should be shared. While the law states that marriage mates are equal owners of wealth, Article 47 says that common wealth is created by work during the continuation of the marriage. The job is not defined as work outside the house or at home”, she says.

Aliu, who is based on German law for family, says that her request is only written emphasis on working at home and abroad, to be equivalent.

It's very unfair to act that way, and that's why it should stop right away because it had helped us to reduce cases in the judiciary and helped us, to be a truly just society. We have laws on paper when the works reveal everything else. Women who try to break up or break up suffer social degradation because they have very little. There are times when 1/10 is separated from women. Perhaps you've contributed 10 to 15-20 years to that house, but you're treated as a person who came and you should be grateful that someone gave you a roof and fed you, so it's thinking and it's very backwards”, she said.

Ali adds that changing this law would not only regulate the situation of women and children but regulate and social development, since women with law in power experience extreme discrimination. While adding that it is irrational for him that domestic violence is not considered a criminal offense.

Aliu also says that women in Kosovo have a big problem during the divorce process, as judges and lawyers become corrupt, especially when it comes to influential families, whether economic or political.

The greatest opposition is the work of institutions, corruption of judges, corruption of lawyers, because there are cases when not only judges are corrupted, but your lawyer happens to be corrupt because the other side has influence. Especially do we have the main problem with families that have great influence on society, or they have great economic or political influence. They have a wide circle and then they do favors to people who have them in institutions that they hold in different services. But they don't remember that maybe they're ruining someone's life, the existence of a mother“, she said.

While there is an order for mothers who have been divorced, or are in the process of divorce, to fight for their rights and never give up.

I wanted women in general to be told, never give up on circumstances, because circumstances have to change. Each of us experiences difficult situations, but they strengthen us. We've always been falling, each one of us has been falling, but the force is in that every time you get up, not in that every time you fall”, she said.

Otherwise, Aliu says he has taken this initiative, since he considers it a moral duty and civic duty, in order for future generations not to face problems facing women in Kosovo.
