Kadri Wessel expected to testify against Albin Kurti and other VV '%s' deputies

The head of the country's legislature, Kadri Veseline, is expected tomorrow to appear before the Constitutional Court's court in Pristina to give his testimony regarding the drop of tear gas into the spaces of the Kosovo Assembly. Because of these actions, due to the use of weapons or dangerous means and the obstruction of the official person in carrying out official office, four deputies of Movement “Determin”, Albin Kurti, Donika Kadaj-Bujupi, Albulen Haxhiu and Faton Topalli are charged.

Prime Minister Wessel is expected to attend Wednesday's session in the quality of the witness, when the trial against these four MPs is also preceded.

Contacted by “Justice Vow”, the cabinet of the chief parliament, did not want to confirm whether Wessel will go to the session on Thursday where the “Determination deputies will be tried”.

But, according to sources of “Justice Trust”, within the chief parliament's cabinet, the court's invitation has already been accepted by him.

Days earlier, the head of the legislature himself had declared that the moment he accepted the tribunal's invitation, he would respond positively.

In addition to Wessel, his testimony Thursday, the deputy from the ranks of the Democratic League of Kosovo (LDK), Armend Zemaj, is expected to give it.

Otherwise, Kadri Wessel's testimony was meant to be heard before, but it was impossible because he had missed the December 7th session of this year.

So far their testimony in this court process has been given by MPs Bekim Haxhiu, Blerta Deliu Kodra, Flora Brovina, Naser Osmani, and Nuredin Ibishi.

The VV's four deputies are being charged by the prosecution for criminal acts “the use of weapons” and “obstructing the official person during the performance of the official task”, actions related to the drop of tear gas into Kosovo's Assembly spaces.

The Act against them by the Constitutional Prosecutor in Pristina has been established on December 16th 2015.

Recent hearings were scheduled after many court failures, as the presence of Caday-Buyup Kurt in the courtroom could not be secured.

The court was unable to hold the trial review on 13 September, as deputies Kurti and Cadaj-Bujupi had been missing. Because of the lack of two indictees, the chairman of the court, Bekir Kalludra, had issued an ordinance for forced behavior.

The next session was scheduled on October 10th, but even this time, Caday-Bujupi's Kurt had not appeared in the courtroom. At that session, Judge Kaluldra had stated that the command for forced behavior was accepted by the police stations “Yugu” and “Centre”, but the court had no notice from these police stations.

Kalludra after the 22 November delay of the session had reiterated orders for forced behaviour for the Caday-Buyup Kurt.

While, at the November 22nd session, the three accused deputies had been missing, except Kurti and Kaday-Buyup, the other accused MP, Albulen Haxhiu, had also been missing.

Judge Becir Kaluldra's chairman, in this hearing, had issued arrest warrants for the three accused, Albin Kurti, Donika Kadaj Buyupi and Albulen Haxhiu.

According to Kalulder, the court's act envisioned their ban and arrest, as well as the appointment of the detention action.

The only one who had attended that session had been MP Faton Topalli, with his protector, lawyer Haxhi Milaku.

Continued session was extended indefinitely.

Kosovo Police, on November 24th, in the outer space of the Kosovo Assembly, had arrested three deputies -- Albin Kurtin, Donika Kadaj Buyupi and Albulen Haxhiun. For their arrest, Kosovo police had to use the spray as colleagues of these MPs had tried not to allow their arrest.

After the arrest, the Constitutional Court in Pristina had scheduled a month-long detention measure for the three MPs, but one day later, the Court of Appeals had changed security measures for them.

To Kurt and Kaday-Buyup, the house arrest was scheduled until Haxhi was released.

Meanwhile, on November 26th, Movement “Determination” had organised a holiday after counting the votes, which made Shpend Ahmeti head of Pristina, while domestic arrest measures had also taken part in that cream.

A day later, on November 27th, police had arrested Kadaj-Bujupin Kurt by returning them to custody, where they continue to be under that measure.

In addition, for throwing tear gas into the Kosovo Assembly, co-chaired deputies Ismajli and Ismail Kurteshi from Vetevendosje and Haxhi Shala are also charged by the Kosovo Initiative.
