Mufti Ismaili, charged with two criminal acts “preventing the official person from performing official task” and “maintaining ownership, controlling or unauthorized possession of weapons”.
According to lawyer Shala, the prosecution's suspicion of protecting him, on the critical day had possessed two gas canisters, could not be confirmed by a test, which the prosecution owned, and that confirmation of the temporary seizure of things.
He added that this confirmation contained no random numbers, no protocol numbers, no stamps of accession, no stamp of the institution, no identification of the tools of confiscated items, and that, according to him, the doubt of the can contain tear gas was no proof of their contents.
Lawyer Shala has also rejected the indictment for criminal work “preventing the official person from performing official duties”.
According to him, the prosecution for well - founded confirmation that Ismaili had committed this crime had used only a few videos of recordings.
“I as a protector with the case of watching these video recordings nowhere have I noticed any action of my defense, that the same has taken any action in which it would prevent Kosovo police members from accompanying Albin Kurti. From these videos, it cannot be confirmed that my defense day has used any force or had a member of the police detained to prevent the exercise of official duties” attorney Shala said.
He has added that for the conduct of this criminal act, the central element was the use of force or opportunity, and that according to him, nothing is seen in these videos except members of the Kosovo Police, pushing the Parliament's deputies from the main entrance space.
Similarly, lawyer Shala said that in the evidence he owned, there was no ordinance to the Kosovo Police issued or ordered by the court for the association of Albin Kurti.
Shala has proposed to the court to approve his request to drop the indictment and reject evidence.
Meanwhile, prosecutor Ilaz Beqiri has rejected the lawyer's request Shala, as he said the indictment was legally established and based on evidence and evidence.
According to the prosecutor, after managing the evidence, it will unequivocally prove that accused Ismaili has committed the criminal acts that are placed on burden, as even according to the prosecution's confirmation of the temporary acquisition of items, it turned out that two tear gas canisters, which the defendant had refused to sign, were found and seized.
Beqiri has proposed to the court that attorney Shala's request be rejected and the main review appointed.
Meanwhile, the chairman of the court, Judge Vesel Ismajli, has announced that the act of applying for the dropping of the indictment and rejection of evidence will be submitted in written form.
Otherwise, Ismaili is charged with being found and seized by two tear gas canisters, which he had hidden in his shoes in order to put them into the Kosovo Parliament's shed.
Ismaili, also charged that on November 17, 2015, at the beginning of the Kosovo Assembly, he had prevented Kosovo Police members Isuf Xhemajli, Mehdi Kozhani, Rifat Gashi, Ali Berisha and Faik Krasniqi from carrying out official duties.
According to the indictment, the moment the police had attempted to stop him and escort his other Vetvendosje MP, Albin Kurti, accused Ismaili, approached other MPs in the middle and unable to accompany him to the police.
For these actions, MP Ismaili, the prosecution charges the criminal work “ownership, unlimited control or possession of weapons, and “obstructing the official person during the performance of official task”.
