IKD: No high profile sentenced to effective prison for corruption

The Kosovo Institute for Justice (IKD), with the support of the British Embassy in Kosovo and NED on Thursday, has held the table, titled “War, persecution or amnesty on behalf of the fight against corruption? The solution/Veting? At this table, the report “War, persecution or amnesty was released on behalf of the fight against corruption?”, as a result of monitoring [...]

At this table, the report <x0th) was published, persecution or amnesty on behalf of the fight against corruption?”, as a result of monitoring corruption cases in the prosecutorial system and the judicial system. Along with the six-month report, two bulletins of monitoring of all Constitutional Courts and Prosecutors were released, as well as Pristina's Court of Appeals in three-month periods (Jianar-March 2017 and April-June 2017). During this table, the performance and results of justice institutions were discussed in fighting corruption.

Executive Director of the Kosovo Institute for Justice. Betim Musliu has presented the findings, assessments and recommendations of systematic monitoring of the treatment of corruption cases by courts and prosecutors, saying the fight against corruption in Kosovo continues to take place primarily towards low and medium profile. High test is rarely followed, but even when followed, charges against high profile fail in initial stages in courts. IKD monitoring findings show that from cases deemed during 2016, completed in the first instance by December 2017, 67% of them have failed in court”. Musliu also mentioned high - profile accusations set up in the first six quarters of 2017. “Unlike the previous year in the first six months of 2017, charges have been filed against three high profilers. For two of these people -- Minister of the Ministry for Return and Community, Dalibor Yevtic and former Chairman of the Gjakova municipality -- Pal Lekaj) has failed prosecutors' charges since the initial phase in court, while for the third person (former, Lipjan municipality Chairman Shukri Buja) is still continuing trial procedure”. According to Musliu, the IKD estimates that this trend of failure of high profile charges since 2016, which continued in 2017, testifies that acts of high profile were raised without evidence and evidence for the purpose of their persecution or permanent amnesty.

On the other hand, the IKD executive director said it is now time for the opening of public debate over the beginning of the property process in the Police, Prosecutor and Court.

The ambassador of Great Britain, Mr. Ruairi O'Connell, in his opening address, said Kosovo has no greater challenge than fighting corruption, especially high-level corruption. Sorry I have to say, again, results are missing. There is no high profile person sentenced to effective prison terms because of corruption. A lot of noise is made first, and eventually all are released or received mild sentences. This year, of the three high profile charges, two have failed. Where was the reckoning? ”- said O'Connell.

The chairman of the Commission for Legissation, Albulen Haxhiu, has said there is no logic that justice should be dealt only with cases of low profiles, supporting IKD findings that there are no effective penalties for major cases. Major “Rasts are being left either to predestinate or are being released or sentenced on a condition like this. Enver Hasn's case. I can never house Eulex, who is installed in Kosovo to fight corruption, but what we're seeing is it's emerging that Eulex officials are also involved in such corrus relatives“Haxhiu said.

Haxhiu also claimed to have cited the property process, and for that he has been criticised by judges and prosecutors who, according to her, are afraid that the goal is to eliminate them.

Justice Minister Ablerad Tahiri has said that as far as I'm concerned vetoing still don't have a clear direction on how to go.

“We need to be extremely careful in such a process, the outcome of this process must be drawn, not political or unilateral, but be what our society expects. I'm in favour of starting to prepare the legal basis for the self-injury process. We need to create mechanisms that consistently in due time take place such a” process has been expressed.

Kosovo Judiciary Council chief Nehat Idrizi has spoken of recommendations the IKD has made to the judicial system, saying that it is necessary to set legal deadlines related to tackling corruption cases in accordance with legal obligations “I agree with your recommendation. Only if we ask for the respect of these deadlines will we establish an account in the justice system and we will have results” Idrizi said. /Kosovo pres/
