Azem Syla remains in custody for more than a month

The former Kosovo Assembly delegation from the ranks of the Democratic Party of Kosovo, Azem Syla, will continue to remain in custody for more than a month.
Under the Constitutional Court's decree in Pristina, which has secured “Justice Trust”, the chairman of the court, EULEX Judge Arkadius Seekek, on December 5, 2017, has continued the detention measure, Azem Syla, Ilaz Syla and Ljubisajovic, until January 12th of next year.
Azem Syla, along with 39 other people, in two indictments, are charged with various criminal acts related to organised crime, in the case known as “Earth”.
The argument of the jury's chairman, for the continuation of this provision, is that there is a danger that the three defendants will prevent the procedure that is under way.
On the detention issue, on December 4th of this year, hearings have been held. In that hearing, case prosecutor Danilo Ceccarelli has demanded that three indictees continue custody.
According to the prosecutor's statement, given at this hearing, the appointment of this measure eliminates risks that could be posed by defendants if they were released from the detention measure.
He had stated that in this way the accused would not leave, influence the witnesses, and repeat their works.
While the defence has rejected this requirement, proposing that this security measure be removed and replaced by other measures.
Azem Syla's defender, lawyer Besnik Berisha, has considered the detention measure to be a violation of his client's rights, for the trial at a reasonable time, as according to him, his health condition and protection were getting worse.
Lawyer Berisha had proposed that domestic arrest be appointed as a security measure.
And the defenders of two other indictees -- lawyers Haxhi Milaku, defender of Ilaz Syla and Zivojin Jokanovic, the defender of Ljubisa Vujovic -- have rejected the request for continued detention, demanding that other security measures be appointed to their clients, that Ilaz Syla be presented to the police, while Vujovic leaves bail, to ensure his presence in the procedure.
Former chief of the General Staff of the Kosovo Liberation Army (UÇK), Azem Syla, after issuing an arrest warrant against him and others, was arrested on April 29, 2016.
Later, on April 30th that year, Azem Syla had been assigned a month-long detention measure, as if the same measure had been pronounced to the other two indictees in this case Ilaz Syla and Ljubisa Vujovqi.
On 30 April 2014, the Special Prosecutor of the Republic of Kosovo (PSRK) had issued a decision to initiate investigations into 12 indictees -- Azem Syla, Shaban Syla, Ilaz Syla, Medjid Syla, Arton Vila, Fahredin Gashi, Shpresim Uka, Nuhi Uka, Shpe Maxhu, Edward Gashi, Sabedin Hadzi and Hajrullah Berisha.
In April and June 2015, as well as in March and April 2016, the investigation had been expanded, including Avni Maxhun and Ljubosha Vujovic.
The PSRK, then on October 24, 2016, has filed an indictment in this case, which was confirmed on April 4, 2017.
On 12,13 and December 15, 2016, initial sessions have been held, with what ones Azem Syla and others declared innocent of charges they were charged with.
The Special Prosecutor of the Republic of Kosovo (PSRK) has filed two charges, one with 17 people and the other with 22 persons, including the former delegation of PDK Azem Syla, who according to the SPRK, had also been leader of this group.
The instance charges the defendants with criminal acts “organised”, “money laundering”, “receive mics”, “heavy malming”, “duty “, “reference to counterlegal judicial decisions”, “The bad use of the official post”, <x14delegisation of the counterfeit context <x> and <x16166>
The defendants are also charged that, in co-operation, through criminal activities, they have deprived Kosovo of social property, including forging official decisions and documents, fraud and other corrupt actions.
Investigations in this case were also made in co-operation with the High Prosecutor for Organised Crime in Belgrade. /Regression/
