EULEX has reacted through a media communiqué in the case of their judge, Malcolm Simmons, who has resigned from this position, throwing grave accusations of corruption within EULEX. EULEX says Judge Simmons, over the past year has been under investigation, as there have been serious claims against him.
EULEX has stated that over the past year, Malcolm Simmons has been the target of some independent investigations into some serious claims against him. EULEX says these investigations are being conducted by a team that is created and located in Brussels, led by a former judge of the European Court of Justice.
These claims are in various phases of the investigation, while some of them have been sent to a Disciplinary Bord and are now awaiting this Board's decision. The others are still ahead of”, EULEX says.
The Express newspaper has sent questions to the EULEX Information Office in the morning Thursday, and the same have responded by means of a media communiqué.
In an interview published in French media “Le Monde”, Judge Simmons, has said EULEX wanted to destroy a part of the Kosovo political class, such as Fatmir Limaj (former KLA commander). He has proceeded, saying EULEX is not the mission of promoting rule of law, but is a political mission.
For these charges brought by Judge Simmons, EULEX has said the claims submitted by the judge are addressed with the same seriousness, and, as well, have resulted in investigations that are under way and developing in the same way as those against it.
EULEX also says that from Simmons, he has been asked to present all the evidence he possesses in support of his claims, “but unfortunately he has not done that, says the EU mission.
“The EU and EULEX implement zero-tolerance policy for improper and bad behaviour, while all members of the Mission are responsible for their actions. Therefore, all claims recently submitted by Mr. Simmons has been treated with the same seriousness and, likewise, resulted in investigations that are under way and developing in the same way as those against him, means in line with the applicable framework, the Code of Conduct and Discipline for the PPSM civilian missions approved by the Council in June 2016. By Mr. Simmons is required to present all the evidence he possesses in support of his claims, but unfortunately he has not yet done so, said EULEX report.
All at the end of their answers, EULEX says it does not prejudge the epilogue of current investigations and welcomes their conclusions, which appropriates will become public.
“EULEX wants to stress that it is the Law Rule Mission with the mandate to assist local authorities”, the announcement said.
