The Court of Appeals rejected Gazmend Halit's complaint against the indictment and evidence for joining the ISIS.
The plea for impeachment of the indictment against the accused has been refused for participation in the terrorist group's activities, I SIS, Gazmend Halit.
In May of this year, attorney Asdren Hoxha has rejected the evidence and has sought to drop the indictment to protect him.
But, the Court of Appeals has rejected lawyer Hoxha's complaint, so the judge's act on the court remains in force of refusing to reject evidence and request to drop the indictment.
The news was made known by attorney Hoxha himself, who, in spite of Apel's decision, told of a call. com that this issue against his client does not contain sufficient evidence.
“Anyway, I think the act in question is not a consequence of the real assessment of the issue, but, at this stage, most of the issues are being allowed to submit to judgment and that it has become a procedural routine at this stage of procedure”, Hoxha said.
The lawyer expects his protector to be released after trial.
“I firmly hold to our positions that this issue does not contain sufficient evidence for eventual punishment, but after the trial we expect a release act”, Hoxha added.
As a result, I am now expected to submit the case to the main judicial examination that will be scheduled for the next few days.
In this trial, the prosecution charges Gazmend Halit that he has deliberately participated in the terrorist group's activities, so that in 2013 he has gone to Turkey, and from there he has moved to Syria, where he has joined the group of Albanians fighting among the terrorist organisation I. SIS.
According to the indictment, he participated in I's activities SIS for several months, struggling to intimidate the population and destroy the fundamental political, constitutional, economic and social structures of Syria.
Aktakuza says that in February 2014, Haliti has gone to Tirana's “Atatturk” airport and has flown from there to the “Rinas” airport in Tirana, along with his fellow fighter at I SIS, Betim Ibrahimaj.
On February 20, 2014, always according to the indictment, the same have been cared into Kosovo through the border point in Vremica.
Currently, Haliti is accused of terrorism along with five other people, even in the case known as “Bavci”, which the Supreme Court turned into retrial on May 17th of this year.
The incident charged the five accused that in July 2015 they had gone to Lake Badovci, near Pristina, to record a propaganda video in which they planned to read the oath to the leader of the terrorist organisation “Islamic State”, known by Short I SIS.
According to the prosecution, this group has intended to publish this video online in order to testify to the world the extent of the so-called “Islamic State” in the Republic of Kosovo.
The Badovci case will be reviewed by the Court of Appeals on 24 October. /Call. com
