Trial of the fatal accident in Pristina, expert says the victim had suddenly appeared on the street

In this case, Vulnet Gashi is accused of having caused the December 2023 accident in Pristina, F. B- as a footman had passed away, reports “Battle for Justice”, Transmitt Periscope.

According to Maxhun, at the moment of the shock the deceased had now fallen to the ground and the traces of injuries left in the car are in the front window on the right side of the car.

He said that by law, pedestrians are allowed to cross the road in a distance of over 50m from the pedestrian crossing.

The hearing has continued with communications expert Durak Cakiqi, who said that based on spatial and time analysis, the driver of the car -- in this case, the accused Gashi -- had no technical opportunity to avoid the accident because the car stopway is longer than the distance of the way he could see the infantry.

Cakqiqi said she thinks that on the basis of the speed and analysis of the accident's course, the impact occurred in the 53.52th second of the video-incision, where the deceased was now hit on the front of the vehicle - respectively on the vehicle registration board on the left side and then on the engine hatch and thrown into the first car glass on the right.

Among other things, he added, sports vehicles, in the case of beating pedestrians due to low altitudes, are thrown higher than in standard vehicles.

Cakqiqi said that according to analytical estimates, if the speed of the movement were up to 21km/h, the accident could be avoided, but over 40km/h speed would be impossible.

Otherwise, this case was on trial at Judge Naim Krasniqi-Jashnica, but because of her degradation by the General Department in the Department of Counter-Religion, the case went to Judge Driton Berisha.

At the initial session on October 18th, 2024, the accused was acquitted of criminal offence.

According to the indictment filed on February 27th 2024 by Pristina Constitutional Prosecutor, accused Vulnet Gashi on December 2nd 2023 on the “Bill Clinton” in Pristina, while driving the car without a driver's driver's license, in the right tape dedicated only to the movement of buses and taxis, from carelessness has acted contrary to the Law on Ritugor Traffic Rules, so that by not adjusting the speed of movement, conditions of the road, and the type in order to stop the vehicle before any obstacle can be presented, and public trafficking has endangered lives.

Always in accordance with the indictment, until now the deceased F.B. was crossing the street, contrary to the Road Traffic Rules Act, outside the pedestrian crossing, from the left-hand side to the right -- at those moments in the medium traffic tape was moving a truck and reaching near “Roleta”, the defendant with the front-side now hits the deceased, who had changed lives as a result of his injuries.

The Autopsy Report of December 12, 2023, says that the death of the deceased F.B. is violent and has resulted from multiple trauma, which indicates also the body injuries the deceased had now received as a result of the accident.

With this, defendant Vulnet Gashi is accused of committing criminal work “The threat of public traffic” by Article 370, paragraph 9 concerning paragraph 6 and paragraph 1 of the Criminal Code. /Periscope
