(an hour ago)The Supreme Court of Kosovo has refused to hold the candidate for MP's complaint from the Democratic Party of Kosovo (PDK), the Kryeziu position, which had called for the full recount of the preferential votes of the country's PDK candidates.
The Supremei has estimated that the PZAP has acted justly in connection with Kryeziu's complaint.
Staying Kryeziu had filed a complaint with the Supreme Court, demanding full recount of the preferential votes within his political subject in the June 7th elections.
According to him, the recount process, ordered earlier by the Central Election Commission (KQZ), has highlighted the inaccuracy in the initial vote count at municipal counting centres.
“As a result, the Supreme Court estimates that PZAP has decided correctly regarding the refusal to appeal to the complainer, the Kosovo Parliament's candidate Kryeziu standing, by the Kosovo Democratic Party (PDK), and that referring to the provision by Article 118.1 of LZP, where it is defined that: “PZAP, accepts fact-based complaints and refuses complaints which do not meet pre-represented criteria” and Article 13 paragraphs 4 of the Order No. 012025 for the PZAP Procedure and Determination Process, where it is defined as “The PZAP can generally refuse a complaint or a six-fold complaint group if they do not present cases of prima facie, or where complaints or complaints group is evidently groundless”. Also with Article 117.3 of the LZP, it is determined that: “Putting on complaints by PZAP is based on clear and convincing evidence”.
On this basis this court has deemed unbased claims high on PZAP that PZAP has rejected the complaint by neglecting the principle of the integrity of the election process by referring to the lack of accuracy of votes won by the candidate, since in the concrete case no clear and convincing evidence has been presented for alleged violations, so P. The ZAP has rightly rejected the complaint as unfounded. Given the fact-confirmed situation, this Court found that in this judicial case, the actual situation has been directly proven and the law has not been violated at the expense of the complaint's claim, so complaints have been rejected as groundless. This is about how they did not prove that they met the causes for which complaints could be filed to present new facts on the interested side, and no procedural offenses were found, nor any actual error that affects the rights of the party or the legality of the procedure”, says the Supreme decision. / Periscopi/
