Special Court: Currently, there is no new decision to postpone the act

The Specialised Chambers of Kosovo months ago have announced that the Judicial Chamber has extended the deadline for declaring the trial by July 2026, while leaving open the possibility of another postponement only if this is considered “absolutely necessary”.

In an answer to news.net, regarding the timing of the verdict, the Court has recalled that on May 5, 2026, the Judicial Chamber issued the order under which the deadline for declaring the court was extended until July 20th.

On that order, the Judicial Chamber also stated that if a further extension was absolutely necessary, it would issue an order on the case at the right time”, the Court's clarification said.

According to Procedure and Tests Rule 159%1, if the random circumstances require more time than the original 90-day deadline, the extra period should not be spent 60 days, unless there is a need for further postponement.

The court has stressed that the decision on an additional deadline remains in the discretion of the Judicial Chamber, which estimates whether the random circumstances make such a measure necessary.

If the Judicial Chamber in this case stipulates that additional time is needed, such a decision will be announced to the parties and will be made public”, the official response reported.

Currently, there is no new decision to postpone beyond July 20, 2026. This means that, based on current information, the bias is expected to be announced within the set term unless the Judicial Chamber decides otherwise in the coming days or weeks.

Former Kosovo President Hashim Thaci, former head of the Assembly, Kadri Veselin, former head of the Parliament, Jakup Krasniqi, and former delegation Rexhep Selimi were arrested in November 2020 and transferred to custody in The Hague after the indictment was confirmed against them by Kosovo's Special Chambers.

They are charged with war crimes and crimes against humanity, which allegedly committed during the period March 1998, September 1999. The prosecution claims that the accused had responsibilities in a joint criminal enterprise through which arbitrary bans, mistreatment, torture, forced disappearance and murder of persons considered political opponents, collaborators or persons suspected of failing to support the KLA.

All four indictees have dismissed all charges and have been declared innocent. The defence has argued throughout the process that the KLA war was fair and liberation, while rejecting the prosecution's claims of individual criminal responsibility for the accused.

The trial began in April 2023 and is considered one of the largest cases under way in the Specialised Chambers. After completing the presentation of evidence by the Prosecutor, the defense and representatives of the victims, the Judicial Chamber is in the phase of preparing the trial, expected to be announced this month./ Periscope.
