The police accused of the 26-year-old accident, demanding harsher sentence

The Court of Appeals on Thursday has held hearings in the case that former police official Silver Kastrati has been sentenced by the Constitutional Court in Pec to four years in prison for the accident in which Mr. J. The damaged side called for the sentence to be toughened, meanwhile, the protection easing of the sentence.
The session was held in front of the Adpel College consisting of the college's Mehmet Ndekaj- Chief Judge Abdullah Ahmeti-a referral judge and Ferit Osmani-member, reports “Justice Vought”.
Judge Ahmeti announced that against the foundation decision, the complaint has been filed against the representative, lawyer Milot Neziraj. Anxiety was brought before because of the decision on punishment
While defender of the accused Kastrati, lawyer Majlinda Sadiki has filed complaints against the Foundation's decision on all complaints grounds, with the proposal for changing Apel's sentence.
The Appeals prosecution has proposed approval of the damaged side's complaint, while accused Kastrati is pronounced the highest sentence, as well as the accused's complaint denied.
At the session, the representative of the damaged party, lawyer Neziraj, stated that in this case the Foundation has overestimated the extenuating circumstances in relation to the fatal following caused. He asked the Appeals College to approve the complaint and accused Kastrati to pronounce the highest sentence.
While the lawyer Sadija said how protection stands behind the exercised complaint, stressing that the four-year prison sentence is too high and does not coincide with the circumstances of this case. It proposed changing the Foundation's decision to defend its defenses with milder condemnation.
Sadij also demanded that the additional punishment of limiting driving be reduced.
At the session, the accused Kastrati himself was declared, expressing regret and apology for the victim's family. He said that any punishment for him does not matter, indicating that the sentence has been handed to himself from that day.
We remember that Kastrati on July 1st 2025 was sentenced by the Constitutional Court in Pec for criminal activity “Public Traffic Reservation”, judging him to 4 years in prison and additional sentence- “taking a license to drive” for four years.
Kastrat had pleaded guilty to initial consideration for the offense.
According to the Constitutional Prosecutor's Act in Pec, it is said that on April 1, 2025, the accused Silver Kastrati, by default, violates the Law on Public Traffic and causes the death of Mr.J. The indictment says that while the defendant was running his vehicle into the road within the settlement where speed limit is 60 km/h, as soon as he reached the pedestrian crossing, where he had been crossing the road from the left side of the vehicle's direction to the right, at a speed of movement of 89.31 km/h, he does not give special attention to the victim and gives no advantage but strikes it with the front of the right side of the car, with his hands causing heavy bodily injuries, which the victim did not survive.
The indictment says that as a result of injuries, the victim, Mr.J., changes lives at the University Clinical Centre in Kosovo.
With these actions, Kastrati was accused of committing criminal work ““Public Traffic Reservation” by Article 370, par. Nine to one. 6 and 1 Criminal Code of the Republic of Kosovo.
