The group for Juridical and Political Studies (GLPS) has reacted after last night's session of the Kosovo Assembly for election of president/e, expressing “serious concern” for the way the process was developed and assessing that it has acted in opposition to the Constitution. According to the GLPS, last night's “session took place contrary to the Constitution of the Republic of Kosovo, turning one of the most important state processes into a political game”.
The GLPS has said the Constitutional Court has been clear that for the development of the president/s vote, the presence of two-thirds of all MPs is required.
“Constitutional Court, case action no. KO 29/11, KO47/16 and K68/26 has been clear that the presence of 2/3 of all deputies, said in response, is required for the president's vote.
Any proceeding beyond this is not a matter of interpretation, but a direct violation of constitutional order”, G stated. LPS.
In this context, G The LPS has estimated that actions taken at last night's session are invalid and that continuing the session in the same form would constitute serious violation of the Constitution.
The “That happens, except that they are all actions undertaken at last night's session, the GLPS estimates that the call for its continuation today in the same form constitutes serious and unacceptable violation of the Constitution”, said in response.
GLPS has added that institutional functionality cannot be built on constitutional violations.
The actions that ignore this arrangement cannot be justified even with the need for institutional functionality, because functionality cannot be built on violations of the Constitution”, it says in response.
Warning of consequences on democratic order, the organisation has said that relativising constitutional requirements puts the country in a dangerous trajectory.
“Such an approach is not only irresponsible but dangerous for democratic order, because it normalises violations and places the country in a trajectory where constitutional norms are replaced by political arbitrariat”, it is said in response.
GLPS has called on MPs to stop actions that, according to them, are illegal and has demanded public and institutional responsibility for possible violations.
“GLPS calls on MPs to stop these illegal and dangerous acts immediately... Those who violate the Constitution must bear full public and institutional responsibility for their actions”, said in response.
