KDI: In the face of recent institutional developments, urgent clarification is needed by the Constitution

KDI has expressed deep regret that, despite successive crises during the past year, political representatives in the Assembly failed to find solutions for the country's president's election.
As it says in a response to KDI, the lack of political and institutional responsibility for reaching an agreement on such an important issue already risks putting the country into a situation of constitutional uncertainty.
“Therefore, given that the current situation that can produce irreversible consequences, we call on the Constitutional Court to, in line with its role as a guardian of the defence of constitutional order and a public interest, use the procedure for accelerated treatment and offer constitutional clarity before the election process develops.
In a constitutional democracy, it is of crucial importance that the actions of institutions that produce major political and institutional consequences rely on a clear interpretation of the Constitution. None of the processes affecting the functioning of institutions and the eventual election processes would have to be held under a constitutional uncertainty. Any delay in such interpretations creates judicial, institutional and political uncertainty”.
The KDI calls on all institutional and political acts to act responsibly and refrain from actions or statements that could contribute to the rise of constitutional uncertainties and further strain of the political situation.
“Respecting constitutional order, institutional maturity and belief in constitutional mechanisms are essential to preserving democratic stability and the normal functioning of domestic institutions”.
