DnVić rejects Osman's decision on the CEC, warns consequences

DnV's response says that the CEC's composition is clearly defined in the constitutional and legal framework through the strict model of representation, and this model does not directly relate to the election result or political weight of subjects in the sense of numbers, but to the principle of balance among parliamentary groups that have the right to propose.
Further mentioned are previous cases, including the period after the 2021 elections, when the CEC's composition is defined on the basis of the strict model by limiting representation of the biggest subject in two members, despite the election outcome.
This practice constitutes a standard ) in harmony with the Code of Good Practice in Election Affairs of the Venice Commission determined to guarantee the institution's balanced functioning”, it is said in response.
DnV has further said that dealing with this issue as the constitutional dilemma and its reference to the court does not contribute to additional clarity, but produces delays in a process requiring direct decision-making.
“The failure to complete the full composition of the CEC violates its constitutional configuration of 11 members, while simultaneously influencing its functioning and decision-making”, is further said in response.
DnV has called for the appointment of the remaining member of the CEC to be completed without further delays, in line with the Constitution, law and standards set in practice, in order to preserve the functionality and credibility of this institution.
The appointment of new members of the CEC has been sent to the Constitutional Court for clarification by President Osmani. The constitutional dilemma, according to the president's cabinet, was raised the cause parties have made more proposals than the Constitution envisions.
The parties submitted proposals to the presidency for as many members as they had in their past composition, besides the LVV, which proposed one more than earlier.
