The court, based on the reading and interpretation of paragraph 2 of Article 86 of the Constitution that stipulates that “the election of the president of the Republic of Kosovo should take place no later than 30) days before the end of the mandate of current President”, re-exxon that this term is binding and final, and that it takes on the binding character of this term, the same cannot be relatable.
However, the Court says that by referring to Article 11 of the Constitution's subparagraph 3 of Article 82, through which the Parliament is determined that the Assembly is distributed in the case when “if within the 60 (60) deadline from the day the selection procedure began, it is not elected president of the Republic of Kosovo”, the Court takes on a specific basis of the context of the constitution's conditions on February 11, 2026, estimated that the Parliament had no sixty (60) days available, within which period the president's selection procedure had to be completed.
“As a result, the Constitutional Court re- heats up that its interpretation of constitutional deadlines defined in paragraph 3 of Article 82 of the Constitution regarding Article 2 of Article 86 of the Constitution, as specified in paragraphs 153-162 of this Act, remains applicable in all cases of the president's election in the future, the procedure for the election of the new president, which cannot last more than sixty (60) days before the end and not until 30 days before the end of the current president's mandate.
“In the end, the Reexon Court that in the wake of the act's entry into force, through which the Assembly is determined that in thirty-four days (34) must continue and complete the election of the head of State, the Parliament fails to elect the new president/re, the Parliament, based on submature 3 of paragraph 1 on Article 82 of the constitution, and therefore, early elections for the Parliament should be held within forty-five (45) days after the distribution of the Parliament, as defined by the paragraph 2nd of MaZl6th and the paragraph 86th of the 15th century [19th].
For these reasons, the Constitutional Court, in accordance with Article 113 of the Constitution, Article 29 of the Law, and rules 48 (1) (a) and 65 of the work regulation, on March 25, 2026, unanimously decides to declare the request of the acceptable LVV.
“BE CONSTTAYS that the decree [r.24/2026] of March 6, 2026 of the president of the Republic of Kosovo does not produce any legal effect; T IT IS time that the deputies of the Republic of Kosovo's Parliament from the day of its entry into force have thirty-four (34) days to hold and complete the procedure of electing the president of the Republic of Kosovo; T IT IS reported that in case the Assembly fails to elect the president within the period specified at the point of this Act's device, based on subgraphy 3 of Article 82 [The Framework Division] of the Constitution of the Republic of Kosovo, the Assembly is distributed ex transitional ex, and therefore, early elections for the Assembly should be held within forty-five (45) days, as specified with paragraph 2 of Article 66 [Mind and Manda] and paragraph 6 of Kosovo's Republic 86th] president. T Um... IT IS reported that the Court's decision to establish the provisional measure, of March 9, 2026, is abolished with the entry into force of this Act”.
The court said this Act comes into force immediately.
