The Supreme Court's judicial college has ruled on the complaint filed by the defense of the accused, D.K., for the criminal offence of murder.
At the session, held on December 22nd 2025, the third-instance college, following a review of the case's papers, claims submitted in complaint, the State Prosecutor's proposal and the response of representatives of the damaged parties, has received a majority of votes, which the defendant's complaint has been denied as unconfirmed, while the Constitutional Court Act on Ferizaj is confirmed and the Court of Appeals's conviction.
Me Prejudice of the first instance, accused Dardan Krivaqa was convicted of serious murder and sentenced to life imprisonment. The prosecution was confirmed by the second - degree court.
Considering the claims submitted by the defendant's defense, the Supreme Court College finds that the court's first and second court judgments contain no substantial violations of criminal procedure provisions and that clear reasons for decision-making have been given.
The judicial college estimates that the lower courts have thoroughly analysed all evidence administered during the trial, including evidence, reports of expertise and material evidence, including videos administered by residences where the accused and the victim have stayed. From these evidence has been found that the victim, M.O., has been in serious physical condition during the critical period and that her injuries have resulted from the accused's violent actions.
The Supreme Court's Judiciary College has also praised the report of autopsy and statements of forensic experts, according to which the victim's death has resulted in multiple body injuries (politics) caused by severe shocks. Hence, it has been found that the victim has experienced severe physical pain during the time of injury, which supports the legal qualifications of the work as a brutal murder.
The judicial college has also reviewed defence claims regarding the retrial procedure, the accused's psychiatric expertise and claims of influence of narcotics substances, arguing that these claims have not been backed by evidence that would question the legality of lower courts' decisions. The report by the Forenzic Psychiatry Institute has found that no mental disorder of the psychotique has been found in the accused and that he has been able to understand his actions.
The Supreme Court's judicial college finds that the life sentence pronounced by the court in the first degree and confirmed by the Second Court is in accordance with the law and the circumstances of the case, taking into account the grave nature of criminal acts, the degree of criminal responsibility and its consequences. /Periscope
