President Osmani would harm the Presidential Institution and our country if he would sue German journalist Michael Martens or his media, FAZ.

 

 

I've read Martin's analysis as a whole and, according to my knowledge of reputation protection, it's legally okay.

Marten's analysis raises an issue of public interest, the way presidential campaign is developed, and issues of public interest enjoy high judicial protection. On the other hand, the scripture offers opinions, assessments and analysis based on the knowledge the author has about Kosovo and on confidential sources. Opinions do not submit to the verification criterion and therefore enjoy broad legal protection.

The only new fact mentioned in the writing is that Rama has provided Osman sitting on the Peace Board, which has not been contested by Osman. The facts are subject to verification, so if this fact is not true, Osman must raise it as a matter.

The president holds the highest position in the country and, as such, her political actions are subject to criticism, even when it is harsh or unpleasant. Freedom of expression and media enables journalists to express, criticise and seek accounts.

For me, disturbing but not surprising, is the fact that the president's office cites criminal law as the form of threat to Marten, though slander is followed according to civil laws in Germany and mentions dezinforms for a writing published by the prestigious newspaper FAZ.

This indictment, if applied to German courts or any court in which the law rules, has no chance of winning. What we will gain is only the reputation of using groundless and abusive indictments by representatives of Kosovo institutions against German journalists and media.

We don't need that kind of reputation.
