Supreme declines PZAP ruling, with which PDK was sentenced 5,500 euros, following Sami Lushtak's statements

PZAP has estimated that using such a language is contrary to Article 34 paragraphs 1 under paragraph 1.11, of Law No.08/L-228 for the General Elections in the Republic of Kosovo, in which provisions are said to be: “over the period of campaign, political subject, supporters or candidates are prohibited by making one as follows: 1.11. The use of the tongue, in written form or oral form, can either provoke or provoke, another person to perform an act of violence against others or riches, or either trigger or promote hatred toward others, or publish or use pictures, symbols, or any other material that he has or may have such an impact”.
The panel, in the case of setting the fine as a device of this decision, has taken into account all the circumstances as follows: the nature of its violation and possible influence on the election process in question, scale and weight of violations, the participation of the subject in the previous elections consisting of the political subject The PDK, it has been reported on obligations and responsibilities during the campaign process, violations of the election laws in power that have made the subject in question in these elections, and in previous elections in Kosovo, which means the same is reported by election rules.
The Supreme Court of Kosovo, beginning with such a situation in the case, has rejected PZAP's stance as right and legitimate for approval of the complaint filed by political subject Movement Vetevendosje (LVV).
“With evidence found in the subject documents, such as complaints along with the evidence offered at PZAP, as well as complaints to this court, it is clear that in this case there is no violation of the Code of Goodwill for Political Subjects, their supporters and candidates, respectively, with provisions of Article 34 paragraph 1.11, of the LZP, with which it is determined: “During the campaign period, the political subject, supporters or his candidates are stopped by doing one as follows: 1.11. The use of the tongue, in written form or oral form, can either provoke or provoke, another person to perform an act of violence against others or riches, or either trigger or promote hatred toward others, or publish or use pictures, symbols, or any other material that he has or may have such an impact”. Of the evidence found in the subject paperwork, the specific evidence offered by the complaint is seen that the candidate for the head of the Skenderaj municipality, Sami Lushtaku, at the rally of citizens held in this city on 1909.2025, for electoral purposes, has declared: the most vile <x3-government, the most misleading government, the most anti-national government, I don't believe there are after Kosovo”.
